R-62-19 <br />RESOLUTION OF THE CITY COUNCIL OF THE CITY <br />OF COLTON AUTHORIZING THE CITY OF COLTON TO <br />WITHDRAW FROM MEMBERSHIP IN THE JOINT <br />POWER AUTHORITY KNOWN AS THE POWER <br />AGENCY OF CALIFORNIA <br />WHEREAS, on or about April 16, 1990 the City Council of the City of Colton took action <br />to form a joint power authority pursuant to Article 1 of Chapter 5 of Division 7 of Title 1 of the <br />Government Code of the State of California known as the Power Agency of California (PAC). The <br />City formed PAC along with the Cities of Azusa, Banning and Riverside in order to realize <br />economic benefits, more efficient resources utilization and sharing technical and legal costs. The <br />joint power authority was formed and operates under a joint power agreement; and; <br />WHEREAS, the PAC joint powers agreement allows the City to withdraw from PAC <br />upon the following conditions: (i) filing with PAC a resolution of the City Council which <br />expresses the City's desire to withdraw; and (ii) the City paying, or making arrangement to pay, <br />its pro rate portion of any obligations; and; <br />WHEREAS, the City Council wishes to adopt this Resolution in order to withdraw from <br />PAC since the City does not have any current projects with PAC and the City has completed all <br />projects and obligations which the City had with PAC. In addition, the City does not anticipate <br />the need to participate in any future projects with PAC. <br />NOW, THEREFORE, the City Council of the City of Colton, State of California do <br />hereby resolved as follows: <br />SECTION 1. WITHDRAWAL FROM PAC. Pursuant to Section 14 of the PAC joint <br />power agreement, the City hereby withdraws form PAC. <br />SECTION 2. IMPLEMENTATION OF WITHDRAWAL. The City Manager or his <br />designee are hereby authorized and directed to take all actions and do all things necessary or <br />desirable hereunder with respect too withdrawing from PAC, including, but not limited to, <br />execution of any documents and completion of any outstanding obligations under the PAC joint <br />power agreement. <br />-1- <br />
