R-65-19 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />COLTON AUTHORIZING A SECOND AMENDMENT TO JOINT <br />POWERS AGREEMENT OF THE CONSOLIDATED FIRE <br />AGENCIES TO ADMIT CHINO VALLEY INDEPENDENT FIRE <br />DISTRICT AS A PARTY AND APPLE VALLEY FIRE <br />PROTECTION DISTRICT AS A PARTY <br />WHEREAS: Chino Valley Independent Fire District ("Chino Valley") is a California <br />fire protection district duly organized and existing under Section 13800 et seq. of the Health <br />& Safety Code; and <br />WHEREAS: Apple Valley Fire Protection District ("Apple Valley") is a California <br />fire protection district duly organized and existing under Section 13800 et seq. of the Health <br />& Safety Code; and <br />WHEREAS: Consolidated Fire Agencies ("CONFIRE") is a joint powers authority <br />duly organized and existing under Section 6500 et seq. of the Government Code and its Joint <br />Powers Agreement effective August 13, 1990 and amended September 17, 2013 <br />(collectively, the "JPA"), which is set forth in Appendix 1 ("Original Agreement') and <br />Appendix 2 ("First Amendment') to Exhibit A; and <br />WHEREAS: as set forth in Exhibit B hereto ("Board of Directors Chino Valley <br />Resolution") and Exhibit C hereto ("Board of Directors Apple Valley Resolution"), the <br />Board of Directors of CONFIRE has recommended that each current party to the JPA agree <br />to amend the JPA to: <br />a. admit Chino Valley as a party and a member of CONFIRE on the condition <br />that Chino Valley pay the Required -Buy -In in the amount of Four Hundred <br />Twelve Thousand Four Hundred Twenty -Three Dollars ($412,423.00) on or <br />before December 31, 2019; and <br />b. admit Apple Valley as a party and a member of CONFIRE on the condition <br />
