Three (3) or more verified complaints or occurrences within a one (1) <br />month period, or six (6) or more verified complaints or occurrences within a three (3) <br />2 month period, or twelve (12) or more verified complaints or occurrences within a one <br />3 (1) year period regarding disturbances or criminal activity caused by patrons, staff or <br />other persons at or near or leaving from the business facility on the subject property, <br />4 shall be grounds for revocation of this conditional use permit. For purposes of this <br />condition, verified complaints shall be defined as complaints received by the City of <br />5 Colton, Colton Police Department, or any other law enforcement agency or any <br />6 governing agencies regarding the violations of federal, state, or local laws. Occurrences <br />shall be defined as any violation of federal, state, or local laws, including but not limited <br />7 to the Alcohol Beverage Control (ABC) Act, for which patrons, staff or other persons <br />frequenting the location are cited or arrested at, near or leaving from the subject <br />8 property. These grounds for revocation are not exclusive. <br />9 v. Revocation or Modification: Should the Chief of Police, in his sole and subjective <br />discretion, deem the number of calls for police service attributable to the location to be <br />10 excessive, or pose a burden to the time and resources of the Colton Police Department, <br />11 or a nuisance to the City of Colton or surrounding neighborhood, the conditional use <br />permit will be subject to review and potential revocation or modification. The permittee <br />12 acknowledges that any violations of these conditions of approval or violations of <br />federal, state or local laws and ordinances shall constitute good cause and subject the <br />13 conditional use permit to revocation or modification proceedings <br />14 BUILDING <br />15 24. Shall comply with the latest adopted edition of the following codes: <br />California Building Standards Code (Title 24, California Code of Regulations) <br />16 Building Code its appendices and standards. The 2016 edition of the California Codes became <br />17 effective for all permit applications submitted after January 1, 2017. <br />a. Building Code <br />18 b. Building Security Code <br />19 c. Electrical Code <br />d. Energy Efficiency Standards <br />20 e. Fire Code and its appendices and standards <br />21 f. Green Code <br />g. Mechanical Code and its appendices and standards <br />22 h. Plumbing Code and its appendices and standards <br />23 25. Applicant shall submit a complete set of construction drawings for review and approval prior <br />24 to construction and occupancy <br />26. Any temporary building, trailer, commercial coach, etc. installed and/or used in connection <br />25 with a construction project shall comply with City Code and Regulations. <br />27. All property lines, easement lines, etc. shall be located and/or relocated in such a manner as to <br />26 not cause any existing structure to become non -conforming with the requirements of the latest <br />27 adopted edition of the Building Code, or any other applicable law, ordinance, or code <br />28 <br />-6- <br />
