R-35-16 <br />A RESOLUTION OF THE OF THE CITY OF COLTON CITY COUNCIL <br />DENYING THE APPEAL AND UPHOLDING THE PLANNING COMMISSION'S <br />DECISION TO APPROVING MODIFY CONDITIONAL USE PERMIT (DAP -000- <br />641) ALLOWING MODIFICATION OF SEVERAL CONDITIONS OF APPROVAL <br />TO ALLOW A PALLET MANUFACTURING, DISTRIBUTION AND PALLET <br />STORAGE USE ON PROPERTY LOCATED IN THE M-1 / SDA (LIGHT <br />INDUSTRIAL / SENSITIVE DEVELOPMENT AREA) ZONE ON PROPERTY <br />MEASURING APPROXIMATELY 3.12 ACRES IN SIZE OF A LARGER SITE <br />THAT MEASURES 6.7 ACRES IN AREA. (FILE INDEX NO. DAP -001-187) <br />WHEREAS, an application (File Index No. DAP 001-187) was filed with the City of <br />Colton by Frank Shean, President of Valley Pallets, Inc., (hereinafter "Applicant") for Modification <br />of Conditional Use Permit (DAP -000-641) requesting modification of several conditions of <br />approval to allow a pallet manufacturing, distribution, and pallet storage use on property located in <br />the M-1 / /SDA (Light Industrial / Sensitive Development Area) Zone on property measuring <br />approximately 3.12 acres lease area of a larger site that measures 6.7 acres consisting of six parcels; <br />WHEREAS, on May 17, 2016, the City Council of the City of Colton held a duly noticed <br />public hearing at which time all persons wishing to testify in connection with the application were <br />heard and the Application was fully examined; and <br />WHEREAS, pursuant to the California Environmental Quality Act ("CEQA"), Section <br />15301 (Existing Facilities), the project is categorically exempt from CEQA because the project <br />meets the criteria for existing facilities in size and location and would not result in significant <br />environmental impacts. <br />WHEREAS, all other legal prerequisites to the adoption of this Resolution have occurred. <br />BE IT NOW THEREFORE RESOLVED AS FOLLOWS: <br />SECTION 1. Based on the entire record before the City Council and all written and oral <br />evidence presented, and the findings made in this Resolution, the Planning Commission hereby <br />finds that: <br />a. The provisions for vehicular parking and for vehicular and pedestrian circulation on <br />the site, and onto adjacent public Right -of -Way will not create safety hazards; The <br />proposed modification to conditional use permit for an approved pallet manufacturing, <br />distribution and storage use will provide adequate circulation, parking, and landscaping <br />for the site because of the number of employees and low numbers of visitors to the site, <br />visitors arrive on occasion, the proposed 59 parking spaces are adequate number of off- <br />street parking for the use. In addition, the adjacent right-of-way is adequate and <br />provides direct access onto Lincoln Street, a paved street with sidewalk and landscaped <br />street verge running the full length of the subject property and with the installation of <br />
