The proposed Development will not impose an undue burden upon off-site public <br />services, including sewer, water and streets, which conclusion shall be based upon a <br />written report of the City Engineer; and there is no provision in the capital works <br />program of the City to correct the specific burden within a reasonable period after the <br />development will be completed. The proposed modification to conditional use permit is <br />meant to clarify conditions of approval, organize responsibility and consequences for <br />not complying and provides updated language and conditions related to the <br />maintenance, operation and management operation of the pallet manufacturing, <br />distribution and pallet storage use, which will not be a burden on existing sewer, water, <br />electric, and street services. If conditions of approval are not met within a 90 days from <br />the date of conditional use permit approval, any and all entitlements related to the pallet <br />manufacturing, distribution and pallet storage use will be investigated and reviewed for <br />revocation of permits as allowed by the Zoning Code. <br />SECTION 2. The City Council of the City of Colton, in accordance with the California <br />Environmental Quality Act, has found that the project will not have a significant impact on the <br />environment and is Categorically Exempt from CEQA under Article 19, Section 15301, Class 1 <br />(Existing Facilities) of the CEQA Guidelines. This section pertains to the proposed project which <br />does not rise to a level of significant environmental impact and will not be detrimental to the health <br />and welfare of the surrounding neighborhood. <br />SECTION 3. Based upon the findings set forth in Sections 1 and 2 of this Resolution, the <br />City Council hereby denies the Appeal and upholding the Planning Commission's decision to <br />approve the Modify Conditional Use Permit (DAP -000-641), subject to the attached conditions of <br />approval (Exhibit "A"). <br />SECTION 5. This land use entitlement shall become null and void if not exercised within <br />one (1) year, unless conditioned herein, of this approval and the applicant has not been granted an <br />extension of time by the Planning Commission, pursuant to Section 18.58.070 of the Colton <br />Municipal Code. <br />-3- <br />
