I RESOLUTION NO. R-68-16 2 A RESOLUTION OF THE CITY COUNCIL OF COLTON, CALIFORNIA 3 AUTHOFACILITIES DISTRICT NO. 90-1 FOR FISCAL YEAR 2016/201ZING THE LEVY OF A SPECIAL TAX IN 7. 4 5 WHEREAS, the CITY COUNCIL of the CITY OF COLTON, CALIFORNIA 6 previously undertook proceedings to form a community facilities district (this Community 7 Facilities District is designated as COMMUNITY FACILITIES DISTRICT NO. 90-1 and is 8 referred to herein as the "District'), and conducted an election and received a favorable vote 9 from the qualified electors authorizing the levy of a special tax in the District, all as authorized 10 pursuant to the terms and provisions of the "Mello -Roos Community Facilities Act of 1982", 11 12 being Chapter 2.5, Part 1, Division 2, Title 5 of the Government Code of the State of 13 California (the "Act"); and 14 WHEREAS, the Act authorized the City Council to levy the special taxes at the rate 15 and apportion them in the manner as approved by the qualified electors and further authorized 16 17 the City Council to thereafter provide, by resolution, for the levy of the special tax in the 18 current tax year or future tax years at the same rate or at a lower rate than the rate provided by 19 the ordinance; and 20 WHEREAS, the City Council desires to authorize the levy of the special tax by 21 resolution for the current and all future tax years. 22 23 NOW, THEREFORE BE IT RESOLVED, DETERIVHNED, AND ORDERED BY THE 24 CITY COUNCIL FOR THE DISTRICT, AS FOLLOWS: 25 SECTION 1. That the above recitals are all true and correct. 26 SECTION 2. That the City Council does, by the passage of this resolution, authorize 27 28 the levy of special taxes at the rate and formula as set forth in Exhibit "A" attached hereto, 29 referenced and so incorporated.
