R-72-16 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COLTON, CALIFORNIA, UPDATING CERTAIN PLANNING AND BUSINESS LICENSE FEES FOR SERVICES PERFORMED BY AND FOR THE CITY, ESTABLISHING NEW FEE, AND REPEALING SELECTED FEES ADOPTED BY RESOLUTION NO. R-05-13. WHEREAS, on February 5, 2013, the City Council adopted Resolution No. R-05-13, which established a Citywide Master Fee Schedule, including Planning and Building fees; and WHEREAS, on April 19, 2016, the City Council adopted Resolution No. R-30-16, which rescinded certain fees in Resolution No. R-05-13, and updated and adopted new certain Planning and Building user fees for the Development Services Department; and WHEREAS, Resolution No. R-30-16 did not update Conditional Use Permit fees, Business License Administration fees, or adopt a fee for a new permit category: Minor Conditional Use Permit; and WHEREAS, the City has conducted a nexus analysis of certain Planning and Business License Administration fees to ensure that said fees accurately reflect the cost of performing Planning and Business License services; and WHEREAS, the City's analysis of said fees has identified certain fees that should be adjusted (Conditional Use Permit and Business License Administration fees), and new fees that should be adopted (Minor Conditional Use Permit) to ensure that said fees are an accurate reflection of the services that are performed; and WHEREAS, only certain portions of Resolution No. R-05-13 shall remain after adoption of this Resolution; and WHEREAS, a properly noticed public hearing was conducted on July 19, 2016 to receive public comments on the proposed changes to Development Services fees and charges. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Colton does hereby find, determine and declare as follows: SECTION 1. Adoption of Fees and Charles. The fees and charges set forth in Exhibit "A" attached hereto and incorporated herein by reference shall take effect and be in force according to law. SECTION 2. Supporting Evidence & Study. The adoption of this Resolution is based on all oral and written evidence prepared by and/or presented to the City, including but not limited to, the Fee Nexus Analysis, prepared by the City with input from all affected departments. This study, which documents that all approved fees and charges do not exceed the cost to the City of providing noted services, is hereby accepted by the City Council. 1
