R-75-16 <br />A RESOLUTION OF THE CITY COUNCIL OF THE <br />CITY OF COLTON, CALIFORNIA, REQUESTING THE <br />BOARD OF SUPERVISORS OF SAN BERNARDINO <br />COUNTY TO CONSOLIDATE A GENERAL <br />MUNICIPAL ELECTION TO BE HELD ON NOVEMBER <br />8, 2016 WITH THE STATEWIDE GENERAL ELECTION <br />TO BE HELD ON THE SAME DATE PURSUANT TO <br />SECTION 10403 OF THE ELECTIONS CODE. <br />WHEREAS, by adoption of Resolution No. R-41-16 on June 7, 2016, the City <br />Council has called and given notice of a General Municipal Election to be held on November <br />8, 2016 in the City of Colton, County of San Bernardino, for the election of three members of <br />the City Council for a term of four years, a City Clerk for a term of four years, and a City <br />Treasurer for a term of four years; and <br />WHEREAS, the City Council is submitting to the voters a question related to the <br />City's transient occupancy (hotel) tax ("TOT"); and <br />WHEREAS, it is desirable that the General Municipal Election be consolidated with <br />the Statewide General Election to be held on the same date and that within the City the <br />precincts, polling places and election officers of the two elections be the same, and that the <br />San Bernardino <br />County election department canvass the returns of the General Municipal Election and that the <br />election be held in all respects as if there were only one election. <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF COLTON, <br />CALIFORNIA, DOES HEREBY FIND, DETERMINE AND RESOLVE AS <br />FOLLOWS: <br />SECTION 1. Request for Consolidation. Pursuant to the requirements of Section <br />10403 of the Elections Code, the Board of Supervisors of the County of San Bernardino is <br />hereby requested to consent and agree to the consolidation of a General Municipal Election <br />with the Statewide General Election on Tuesday, November 8, 2016, for the purpose of <br />submitting to the voters the question relating to the City's TOT tax. <br />SECTION 2. Measure Language. The measure is to appear on the ballot as follows: <br />"Shall the City of Colton increase the Transient Occupancy <br />(Room) Tax rate from 10% to 12.5%, with the extra 2.5% rate Yes <br />increase generating approximately $150,000 annually that will <br />specifically pay for the construction, maintenance and <br />rehabilitation of the City's athletic/recreational fields and related <br />facilities, until ended by voters, and to apply the Tax to all rent <br />charged by hotel operators, including online travel and short term No <br />rental companies, for transient occupancy of any hotel room?" <br />
