The Recitals set forth above are true and correct and are incorporated herein <br />by reference. <br />SECTION 2. Based on the entire record before the City Council and all written and oral <br />evidence presented, including the staff report, the City Council finds that the findings required <br />for the issuance of a conditional use permit can be made based on the following: <br />That the proposed Use is in accord with the General Plan, the objectives of this <br />title, and the purposes of the zone in which the site is located; The proposed Type <br />21 Alcoholic Beverage Control license for an existing market is consistent with the <br />following General Plan Update goals and objectives: <br />A. General Plan Update Goal LU -9. "Maintain a diverse mix of commercial uses that <br />benefit the community in terms of needed commercial services, tax revenue, and <br />employment opportunities." The proposed addition of the sale of distilled spirits at <br />an existing market will allow for the business to grow its business by expanding the <br />diversity of its products which will lead to increased tax revenue. <br />B. General Plan Update Policy LU -3.1: "Provide for land uses that allow a variety of <br />retail, service, manufacturing, institutional, office, and recreational businesses to <br />locate in Colton." The existing market with a proposed Type 21 ABC License will <br />provide for a greater variety of retail uses within the C-2 zone and is compatible with <br />surrounding uses at this specific location. <br />2. That the proposed Use, together with the conditions applicable thereto will not be <br />detrimental to the public health, safety or welfare, or materially injurious to <br />properties or improvements in the vicinity; The proposed addition of the sale of <br />distilled spirits at an existing market will not be detrimental to the public health, <br />safety or welfare or materially injurious to properties or improvements in the vicinity <br />for the following reasons: <br />A. The proposed use hours of operation are acceptable for the commercial location of <br />the subject site and the surrounding properties. <br />B. Conditions have been placed on the alcoholic beverage control license which will <br />mitigate any potential impacts created by the use and ensure that the use will not <br />negatively affect the surrounding community. <br />-2- <br />
