R- 09-15 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COLTON <br />REVISING THE CITY'S PRETREATMENT PROGRAM ENFORCEMENT <br />RESPONSE PLAN <br />WHEREAS, the City of Colton (City) has adopted a Sewer Use Ordinance which <br />regulates the discharge of non-domestic waste into the sewerage system of the City; and <br />WHEREAS, it is necessary for the City to enact a Pretreatment Program Enforcement <br />Response Plan (ERP) and designate the Public Works & Utility Services Director as the <br />administrator of this program for the City; and <br />WHEREAS, the City initially adopted the ERP on April 19, 1994 with Resolution No <br />R-14-94;and <br />WHEREAS, the City adoopted amendments to said ERP on September 1, 2009 with <br />Resolution No R-68-09; and <br />WHEREAS, the City is required to review and update, as necessary, the existing ERP <br />to reflect new state and federal reqirements regarding the implementation of the Pretreatment <br />Program; pretreatment violations; and <br />WHEREAS, the City's existing ERP was determine to lack new federal program <br />requirements as identified in the Pretreatment Compliance Audit (PCA) Summary Report <br />dated February 26, 2013; <br />NOW THEREFORE BE IT RESOLVED that the City council of the City of <br />Colton does hereby adopt the Pretreatment Program Enforcement Response Plan (ERP), <br />which is attached hereto as "Exhibit A" and incorporated by reference. <br />Resolution R-09-15 <br />Page I <br />
