Based on the entire record before the City Council and all written and <br />oral evidence presented, including the staff report, the City Council <br />SECTION 2. The City Council has reviewed the Environmental Assessment ("EA") <br />and all comments received and, based on the whole record before it, determines: (i) that as Lead <br />Agency under the California Environmental Quality Act ("CEQA"), the City of Colton shall use <br />the EA prepared for the HCP as the CEQA Initial Study as allowed pursuant to CEQA <br />Guidelines Section 15221. On the basis of the findings of the EA, the Lead Agency staff has <br />concluded that the project will not have a significant effect on the environment and has <br />therefore prepared a draft Negative Declaration in compliance with CEQA; and (ii) that there is <br />no substantial evidence that the project will have a significant effect on the environment. The <br />City Council further finds that the Negative Declaration reflects the independent judgment and <br />analysis of the Lead Agency. Therefore, the City Council hereby adopts the Negative <br />Declaration. <br />SECTION 3. Based upon the findings set forth herein, the City Council hereby <br />approves the West Valley HCP, including Biological Opinion and Permit Terms & Conditions <br />and directs staff to proceed with implementation actions contained therein. <br />PASSED, APPROVED AND ADOPTED, this 3`d day of February, 2015. <br />AT T: <br />CAROLINA R.
