The SDA (Sensitive Development Area Overlay) Zone Requires a Conditional Use <br />2 Permit. <br />3 <br />4 History - On December 4, 1984, the City Council adopted Ordinance No. 1671 approving the <br />5 zoning text amendment for the Sensitive Development Area (SDA) Overlay zone to allow change <br />of zone from M-1 to M-1/SDA (Sensitive Development Area Overlay) zone and General Plan <br />6 Amendment for various properties in the area including 240 E. Congress Street. <br />7 <br />8 Present Day - The current zoning maps also designate this area as M-1/SDA. Title 18, Chapter <br />9 18.30.030 (Conditional Use Permit Requirements), states that "Plans for all development in the <br />10 SDA Zone shall be submitted to the Commission for review and approval under the Conditional <br />Use Permit." Title 18.04 (Definitions) defines a "development" as follows: <br />11 <br />12 "18.04.166 Development. "Development" means the division of land into two or <br />more Parcels, the construction, reconstruction, conversion, Structural Alteration, <br />13 relocation or enlargement of any Structure; any mining, excavation, landfill or land <br />14 disturbance; and any Use or extension of the Use of land." <br />15 Thus, a Conditional Use Permit is automatically required for any non -vested "use or extension of <br />16 use of land" (Definition of Development) for development within an SDA Overlay Zone. <br />17 <br />18 F. Other City Municipal Codes Classify Contractor Storage and Pallet Manufacture as <br />19 Different Uses. <br />20 A review and survey of the treatment of contractor storage and pallet manufacturing in other local <br />zoning codes, including codes of the cities of Ontario, Riverside, Rancho Cucamonga, Redlands, <br />21 and the Count of San Bernardino differentiate between a <br />Y pallet manufacturing use and <br />22 contractor's storage yard. <br />23 <br />24 SECTION 3.
