Under State CEQA Guidelines section 15162, once a negative declaration <br />has been adopted for a project, no subsequent environmental document shall be prepared for that <br />project unless substantial changes are proposed in the project which would require major <br />revisions of the previous environmental document due to the involvement of new significant <br />environmental effects or if new information of substantial importance which shows that the <br />project will have a significant impact on the environment has been made available. The proposed <br />Conservation Easement and MOU fall fully within the scope of the EA and Negative Declaration. <br />Therefore, the City Council finds that the Conservation Easement and the MOU meet the criteria <br />of State CEQA Guidelines section 15162 such that no new environmental documentation or other <br />further environmental review is required. <br />SECTION 2. The proposed Conservation Easement and MOU are in compliance with <br />and implement provisions of the adopted HCP and Incidental Take Permit No. TE4916413-0 <br />including Special Terms and Conditions, <br />SECTION 3. Based upon the findings set forth herein, the City Council hereby approves <br />the Conservation Easement for the West Valley HCP in favor of the Riverside Land <br />Conservancy; and authorizes entering into a Memorandum of Understanding with the Riverside <br />Land Conservancy to set forth the phasing for granting and acceptance of said Conservation <br />Easement, including funding obligations. <br />PASSED, APPROVED AND ADOPTED this 5"' day of May, 2015. <br />ATTEST: <br />CAROLINA R.
