10 <br />I <br />12 <br />13 <br />14 <br />15 <br />101 <br />17 <br />18 <br />19 <br />20 <br />21 <br />22 <br />23 <br />24 <br />25 <br />26 <br />27 <br />28 <br />Ila <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COLTON, <br />CALIFORNIA, APPROVING MUNICIPAL SOLID WASTE AND DISPOSAL <br />SERVICE RATES FOR FISCAL YEAR 2015/2016. <br />WHEREAS, the City of Colton is a municipal corporation duly organized and existing <br />pursuant to the Constitution and laws of the State of California ("City"); and <br />WHEREAS, the City operates a municipal solid waste collection system that transports and <br />disposes of all solid waste collected from residential and commercial customers within the City, <br />via an exclusive franchise agreement ("Franchise Agreement") with Republic Services, Inc.; and <br />WHEREAS, due to increasing costs of solid waste disposal at landfills (so called "tipping" <br />fees) and other operational costs in providing solid waste collection services, the current level of <br />solid waste service rates (hereinafter collectively referred to as "rates") is insufficient to recover the <br />total costs of providing said services; and <br />WHEREAS, on April 7, 2015, the City prepared a Staff Report and presented it to the City <br />Council, analyzing the City's revenue requirements and the rate structure that should be adopted to <br />proportionately allocate the costs of providing solid waste service to its residential and commercial <br />customers; and <br />WHEREAS, a copy of the Staff Report is on file with the City Clerk and by this reference is <br />made a part of the record of these proceedings; and <br />WHEREAS, the Franchise Agreement allows for increases in solid waste rates due to <br />increasing costs, as outlined more particularly above; and <br />WHEREAS, based upon the data contained in the Staff Report, the City proposes to increase <br />its solid waste rates in accordance with California law in an amount that corresponds to the amount <br />necessary for the collection, conveyance, recycling and disposal of solid waste via the City's <br />Franchise Agreement. Therefore, the City Council finds, with respect to the revenue derived from <br />the increased rates, that (1) there is a reasonable relationship between the use of the rates increased <br />herein and the services for which they are imposed; (2) the revenue derived from the increased rates <br />does not exceed the amount necessary to provide the services; (3) the increased rates shall not be <br />used for any purpose other than that for which the rates are imposed, including but not limited to, <br />solid waste pick-up, transportation, recycling, disposal, facilities and equipment maintenance, <br />capital projects and financing, and billing and account management; (4) the increased rates do not <br />exceed the proportional cost of the services attributable to each customer; and (5) the increased <br />rates are not levied for general governmental purposes; and <br />WHEREAS, the service rates for fiscal year 2015/2016 have been included as Exhibit A <br />to this Resolution; and <br />
