The recitals and findings preceding this Resolution are true and correct and <br />are incorporated into this Resolution by this reference. <br />SECTION 2. Under Section 15162 of the State CEQA Guidelines (Title 14 California Code of <br />Regulations Sections 15000, et seq.), once a negative declaration has been adopted for a project, no <br />subsequent environmental document shall be prepared for that project unless substantial changes are <br />proposed in the project which would require major revisions of the previous environmental document <br />due to the involvement of new significant environmental effects or if new information of substantial <br />importance which shows that the project will have a significant impact on the environment has been <br />made available. The proposed Donation Agreement falls fully within the scope of the Environmental <br />Assessment and Negative Declaration completed for the HCP. Therefore, the City Council finds that the <br />approval of the Donation Agreement meets the criteria of State CEQA Guidelines section 15162 such <br />that no new environmental documentation or other further environmental review is required. <br />SECTION 3. The City hereby approves the Donation Agreement in substantially the <br />form attached hereto as Exhibit "A" by and between the City of Colton and Carl Ross, Trustee <br />of the Carl Ross Living Trust, for the donation of the Donor Property. <br />SECTION 4. The City Manager or his designee is hereby authorized to sign and enter <br />into the Agreement on behalf of the City and to take all actions and sign, make, enter into and <br />deliver all documents by or on behalf of City necessary to carry out the purposes of the <br />Donation Agreement. <br />SECTION 5. The City Clerk shall certify to the adoption of this Resolution and this <br />Resolution shall become effective immediately upon its adoption. <br />PASSED, APPROVED AND ADOPTED this 16th day of June, 2015. <br />A <br />T <br />Carolina R.
