R-95-15 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COLTON <br />APPROVING THAT CERTAIN PURCHASE AND SALE AGREEMENT <br />AND ESCROW INSTRUCTIONS FOR THE SALE AND DEVELOPMENT <br />OF COUNTY REAL PROPERTY PURSUANT TO THAT PURCHASE AND <br />SALE AGREEMENT <br />WHEREAS, the City of Colton ("City") currently owns in fee that certain right-of-way <br />generally located at the southwest corner of Valley Boulevard and Pepper Avenue in the City, <br />and commonly referred to as "Old Valley Boulevard" (the "City Parcel"); and <br />WHEREAS, the County of San Bernardino ("County") owns that certain real property <br />generally located at the southwest corner of Valley Boulevard and Pepper Avenue (APN 0254- <br />071-45-0000), adjacent to the City Parcel and legally described in Exhibit "A" attached to this <br />resolution and incorporated by reference herein (the "County Parcel"); and <br />WHEREAS, the City desires to purchase the County Parcel for its conveyance along with <br />the City Parcel for future development; and <br />WHEREAS, California Government Code Sections 37350 authorizes the City to purchase <br />real property; and <br />WHEREAS, on July 28, 2015, the Planning Commission approved Resolution No. R-13- <br />15 (Exhibit `B"), finding that the proposed purchase of the County Parcel and its sale of both <br />the City and County Parcels is in conformity with the General Plan; and more specifically, in <br />conformity with the Hub City Centre Specific Plan, Zoned Retail, pursuant to California <br />Government Code section 65402; and <br />WHEREAS, the City wishes to purchase the County Parcel for the sale of both the City <br />and County Parcels to Valley -Orange Enterprises, LLC ("Developer") for the development of a <br />full service fueling station, convenience store, quick service restaurant or casual dining, car wash <br />23152.0600 1 \93 83102.2 <br />
