I <br />2 <br />3 <br />4 <br />5 <br />6 <br />7 <br />8 <br />9 <br />10 <br />11 <br />12 <br />13 <br />14 <br />15 <br />16 <br />17 <br />18 <br />19 <br />20 <br />21 <br />22 <br />23 <br />24 <br />25 <br />26 <br />27 <br />28 <br />let contracts"; and <br />WHEREAS, Colton Municipal Code section 3.08.130(A) authorizes emergency <br />contracting without formal competitive bidding provided that California Public Contract Code <br />section 22050 is followed; and <br />WHEREAS, the City Council hereby finds that based on the substantial evidence set forth <br />in this resolution and the minutes of this meeting that the emergency will not permit a delay <br />resulting from a competitive solicitation for bids; and <br />WHEREAS, the City Council hereby finds that based on the substantial evidence set forth <br />in this resolution and the minutes of this meeting that Sewer Main repair is necessary to respond <br />to the emergency. <br />NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF COLTON DOES <br />HEREBY RESOLVE AS FOLLOWS: <br />1. The Sewer Main damage constitutes an "emergency" under section 1102 of the <br />California Public Contract Code. <br />2. The competitive bidding requirements for the Sewer Main repair are waived <br />pursuant to section 22050 of the California Public Contract Code and Colton Municipal Code <br />section 3.08.130(A). <br />3. The Sewer Main repair is authorized pursuant to section 22050 of the California <br />Public Contract Code and Colton Municipal Code section 3.08.130(A). Further, such action shall <br />be reviewed by the City Council at subsequent regular City Council meetings to determine <br />whether there is a need to continue the action. <br />4. The action is exempt from the California Environmental Quality Act ("CEQA") <br />(Pub. Res. Code, §§ 21000, et seq. and Title 14 of the California Code of Regulations, §§ 15000 <br />et seq. ("State CEQA Guidelines")), pursuant to 14 Cal. Code of Regs., §15301 as repair of an <br />existing facility and § 15269 as an emergency project and Staff is hereby directed to file a Notice <br />of Exemption with the San Bernardino County Clerk's Office. <br />-2- <br />
