NOW, THEREFORE, be it resolved by the City Council of the City of Colton: SECTION 1. The Recitals set forth above are true and correct and are incorporated herein by reference. SECTION 2. Based on the entire record before the City Council, all written and oral evidence presented, and the findings made in this Resolution, the City Council hereby denies the Appeal and upholds the decision of the Planning Commission denying the Application. SECTION 3. Based on the entire record before the City Council and all written and oral evidence presented, and grounds required for revocation of conditional use permit established by Title 18 (Zoning Ordinance), Section 18.58.080 (Revocation of Land Use Entitlements), the City Council hereby finds as follows grounds for revocation: SECTION 4. The City Council of the City of Colton, in accordance with the California Environmental Quality Act (CEQA) and the City's CEQA Guidelines, has found that the denial of the project is exempt from the requirements of the California Environmental Quality Act (CEQA) per CEQA Guidelines Section 15321, Enforcement Actions by Regulatory Agencies, which exempts enforcement actions taken by a permitting agency, including revoking a use permit due to violations of the operational conditions of said permit by an applicant. SECTION 5. The City Clerk shall certify to the adoption of this Resolution. SECTION 6. This Resolution shall become effective immediately upon its adoption.
