R-71-14 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COLTON, <br />CALIFORNIA, APPROVING MUNICIPAL SOLID WASTE AND DISPOSAL <br />SERVICE RATES FOR FISCAL YEAR 2014/2015. <br />WHEREAS, the City of Colton is a municipal corporation duly organized and existing <br />pursuant to the Constitution and laws of the State of California ("City"); <br />WHEREAS, the City operates a municipal solid waste collection system that transports <br />and disposes of all solid waste collected from residential and commercial customers within the <br />City, via an exclusive franchise agreement ("Franchise Agreement") with Republic Services, <br />Inc.; <br />WHEREAS, due to increasing costs of solid waste disposal at landfills (so called <br />"tipping" fees) and other operational costs in providing solid waste collection services, the <br />current level of solid waste service rates (hereinafter collectively referred to as "rates") is <br />insufficient to recover the total costs of providing said services; <br />WHEREAS, on May 22, 2014, the City prepared a staff report and presented it to the <br />City Council, analyzing the City's revenue requirements and the rate structure that should be <br />adopted to proportionately allocate the costs of providing solid waste service to its residential and <br />commercial customers; <br />WHEREAS, a copy of the staff report is on file with the City Clerk and by this reference <br />is made a part of the record of these proceedings; <br />WHEREAS, the Franchise Agreement allows for increases in solid waste rates due to <br />increasing costs, as outlined more particularly above; <br />WHEREAS, based upon the data contained in the staff report, the City proposes to <br />increase its solid waste rates in accordance with California law in an amount that corresponds to <br />the amount necessary for the collection, conveyance, recycling and disposal of solid waste via the <br />City's Franchise Agreement. Therefore, the City Council finds, with respect to the revenue <br />derived from the increased rates, that (1) there is a reasonable relationship between the use of the <br />rates increased herein and the services for which they are imposed; (2) the revenue derived from <br />the increased rates does not exceed the amount necessary to provide the services; (3) the <br />increased rates shall not be used for any purpose other than that for which the rates are imposed, <br />including but not limited to, solid waste pick-up, transportation, recycling, disposal, facilities and <br />equipment maintenance, capital projects and financing, and billing and account management; (4) <br />the increased rates do not exceed the proportional cost of the services attributable to each <br />customer; and (5) the increased rates are not levied for general governmental purposes; <br />WHEREAS, the service rates for fiscal year 2014/2015 have been included as Exhibit <br />"A" to this Resolution; <br />n 1 <br />23152.06155\7587585.1 <br />
