R-39-11 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COLTON <br />APPROVING AND ADOPTING A COOPERATION AGREEMENT WITH THE <br />COUNTY OF SAN BERNARDINO FOR THE PURPOSE OF BEING A <br />CONSORTIUM MEMBER OF THE HOME INVESTMENT PARTNERSHIP <br />PROGRAM <br />WHEREAS, the Congress of the United States has enacted the Cranston -Gonzales <br />National Affordable Housing Act, as amended 42 U.S.C. 12701 et seq. and Federal <br />Regulations have been adopted pursuant thereto, (hereinafter called the ACT"); <br />and, <br />WHEREAS, Title II of the ACT creates the HOME Investment Partnership Program, <br />(hereinafter called "HOME"), that provides funds to states and local governments for the <br />acquisition, refinance, rehabilitation, and new construction of affordable housing and tenant - <br />based rental assistance; and, <br />WHEREAS, the ACT allows local governments to form consortia for the purpose of <br />receiving and administering HOME funds and carrying out purposes of the ACT; and, <br />WHEREAS, the County of San Bernardino is authorized to act as a representative for <br />all members of the Consortium for the purposes of the ACT, and to assume overall <br />responsibility for ensuring the Consortium's HOME program is carried out in compliance with <br />the ACT; and, <br />WHEREAS, the City of Colton qualifies as a Metropolitan City and has the option of <br />joining the County's HOME Consortium; and, <br />WHEREAS, the County of San Bernardino has requested that the City of Colton enter <br />into a Cooperation Agreement to participate in the HOME Consortium, which the agreement <br />will go into effect October 1, 2011 and remain in effect until September 30, 2014. <br />NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Colton, <br />as follows: <br />Section 1. That the Cooperation Agreement with the County of San Bernardino for the <br />purpose of being a HOME Consortium member for the HOME Investment Partnership <br />Program, attached hereto and incorporated herein by this reference, is approved and adopted <br />and the City Manager is authorized to execute it on behalf of the City. <br />
