1 <br />2 <br />3 <br />4 <br />5 <br />6 <br />7 <br />8 <br />9 <br />10 <br />11 <br />12 <br />13 <br />14 <br />15 <br />16 <br />17 <br />18 <br />19 <br />20 <br />21 <br />22 <br />23 <br />24 <br />25 <br />26 <br />27 <br />28 <br />ORDINANCE NO. 0-06-17 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY <br />OF COLTON AMENDING SECTION 10.40.070 OF THE <br />COLTON MUNICIPAL CODE RELATING TO THE <br />LENGTH OF TOWING PERMITS AND AGREEMENTS <br />FOR PARTICIPANTS IN THE CITY'S TOWING <br />ROTATION PROGRAM <br />WHEREAS, Chapter 10.40 of the Colton Municipal Code provides the guidance for the <br />selection of towing providers that participate in the City's towing rotation program for the <br />provision of non-consensual towing services; and <br />WHEREAS, Chapter 10.40 authorizes the Chief of Police to promulgate towing rules and <br />specification ("Rules and Specifications") that include reasonable provisions respecting the <br />character, extent, quality and standards governing nonconsensual towing services and tow storage <br />lots, and such other rules and specifications as may be reasonably necessary to facilitate <br />nonconsensual tow services in the best interests of the public; and <br />WHEREAS, Section 10.40.070 provides that towing permits are subject to a specified <br />term; and <br />WHEREAS, the City Council wishes to amend Section 10.40.070 to authorize the Chief <br />of Police to determine the appropriate term of permits issued in accordance with the guidance <br />provided in the Rules and Specifications; and <br />NOW, THEREFORE, the City Council of the City of Colton, California, does ordain as <br />follows: <br />SECTION 1. Incorporation of Recitals. The City Council hereby finds that all of the <br />foregoing recitals presented herewith are true and correct and are hereby incorporated and adopted <br />as findings of the City Council. <br />SECTION 2. Section 10.40.070 of the Colton Municipal Code is hereby amended to <br />read as follows: <br />"10.40.070 - Permit required. <br />No Person Shall engage in the Business of providing towing services to the City's Police <br />Department without first obtaining a towing Carrier Permit from the Police Chief and then <br />obtaining a Business License. Permits Shall be issued for a peried term of not less than three <br />Years and not to exeeed a..e Years -, <br />as determined by the Police Chief and as authorized in the <br />Rules and Specifications.
