2 <br />3 <br />4 <br />5 <br />6 <br />7 <br />8 <br />9 <br />10 <br />11 <br />12 <br />13 <br />14 <br />15 <br />16 <br />17 <br />18 <br />19 <br />20 <br />21 <br />22 <br />23 <br />24 <br />25 <br />26 <br />27 <br />28 <br />ORDINANCE NO. 0-07-17 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF COLTON, <br />ADDING CHAPTER 12.45 TO TITLE 12 (STREETS AND OTHER PUBLIC <br />PLACES) OF THE COLTON MUNICIPAL CODE TO ADDRESS THE <br />PLACEMENT AND MAINTENANCE OF PRIVATE NEWS RACKS ON <br />PUBLIC SIDEWALKS OR PARKWAYS. <br />WHEREAS, the City of Colton is experiencing a proliferation of unregulated, poorly <br />maintained news racks located on City sidewalks and parkways; and <br />WHEREAS, the Colton Municipal Code does not presently provide for a permitting <br />process, locational criteria, or maintenance and enforcement standards for news racks located <br />on public property; and <br />WHEREAS, the City Council now wishes to add Chapter 12.45 to Title 12 (Streets <br />and Other Public Places) of the Colton Municipal Code to ensure that news racks are <br />regulated in a manner that ensures public safety and a neat and orderly appearance of the <br />public realm. <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF COLTON <br />DOES ORDAIN AS FOLLOWS: <br />SECTION 1: Chapter 12.45 of Title 12 of the Colton Municipal Code is hereby added <br />to read as follows: <br />"Chapter 12.45 — REGULATION OF NEWSRACKS ON PUBLIC PROPERTY <br />Sections: <br />12.45.010 Purpose. <br />It is the purpose of this chapter to authorize the placement and maintenance of news racks <br />upon public sidewalks or parkways under the limitations set forth in this chapter. <br />12.45.020 Definitions. <br />As used in this chapter: <br />A. "Director" means the Director of Public Works of the city of Colton or designee thereof. <br />B. `News rack" means any self-service or coin-operated box, container, storage unit or other <br />dispenser installed, used or maintained for the display and sale of newspapers or news <br />periodicals. <br />-1- <br />
