1 <br />2 <br />3 <br />4 <br />5 <br />6 <br />7 <br />8 <br />9 <br />10 <br />11 <br />12 <br />13 <br />14 <br />15 <br />16 <br />17 <br />18 <br />19 <br />20 <br />21 <br />22 <br />23 <br />24 <br />25 <br />26 <br />27 <br />28 <br />WHEREAS, the Planning Commission of the City of Colton ("Planning Commission") <br />held a public hearing on February 28, 2017, after giving published notice, for consideration of a <br />recommendation to the City Council of a Zoning Text Amendment amending Title 18 (Zoning) <br />of the Colton Municipal Code to address permitting for residential indoor marijuana cultivation <br />(RIMC); and. <br />WHEREAS, following the conclusion of said hearing, the Planning Commission adopted <br />their Resolution No. R-02-17, recommending approval to the City Council of an Ordinance <br />amending Section 18.48 (Special Provisions) of Title 18 (Zoning) of the Colton Municipal Code to <br />address permitting for residential indoor marijuana cultivation; and <br />WHEREAS, the City Council has determined that the Code Text Amendment is consistent <br />with the City of Colton General Plan ("General Plan") as indicated below; and <br />WHEREAS, the City Council has determined that the proposed Code Text Amendment is <br />in the best interests of the City, and that it would be in the public interest to approve the Code Text <br />Amendment; and <br />WHEREAS, the Code Text Amendment was reviewed, studied and found exempt from the <br />California Environmental Quality Act ("CEQA") as more fully described below; and <br />WHEREAS, on March 21, 2017, the City Council held a duly noticed public hearing at <br />which persons wishing to testify in connection with the Code Text Amendment were heard and the <br />Code Text Amendment was comprehensively reviewed; and <br />WHEREAS, all other legal prerequisites to the adoption of this Ordinance have occurred. <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF COLTON DOES <br />ORDAIN AS FOLLOWS: <br />SECTION 1. The City Council hereby adopts the recitals and findings set forth above and <br />in the agenda report prepared in connection with this Ordinance. <br />-2- <br />
