<br />C. Cultivation Area
<br />1. Location and Use
<br />(a) One single cultivation area per residential unit is allowed. A residential unit
<br />may not have multiple cultivation areas.
<br />(b) The cultivation area shall be located indoors within a permitted or
<br />otherwise lawful fully enclosed structure, which may include the residence
<br />or accessory structure to that particular residence.
<br />(c) The indoor space to be used for marijuana cultivation shall be conditioned
<br />to support cultivation operations with appropriate building permits to
<br />conform to Building Code requirements including, but not limited to,
<br />flooring, drainage, electrical, lighting systems, mechanical systems and
<br />ventilation, and wall finishes.
<br />(d) Cultivation areas within garages shall not be allowed unless minimum
<br />vehicle parking space clearances are not obstructed.
<br />(e) All plumbing, electrical, and other utilities must be properly permitted by
<br />the City or appropriate regulatory agency.
<br />(f) The cultivation area shall be used exclusively for residential indoor
<br />marijuana.
<br />(g) The cultivation area shall not be used or prepared in a manner to cultivate
<br />more than six (6) marijuana plants.
<br />(h) The following chemicals shall not be used or stored in the cultivation area:
<br />(i) Explosive gases, including, but not limited to: Butane, Propane,
<br />Xylene, Styrene, Gasoline, Kerosene, Oxygen (02), or Hydrogen
<br />(H2).
<br />(ii) Dangerous poisons, toxins, or carcinogens, including, but not
<br />limited to: Methanol, Iso-propul Alcohol, Methylene Chloride,
<br />Acetone, Benzene, Toluene, or Tri -chloro -ethylene.
<br />2. Access and Security
<br />(a) Access to the cultivation area shall be restricted by lockable doors. Any
<br />windows, skylight, ventilation, or other opening must be lockable.
<br />(b) Access to the cultivation area shall be restricted to permit holders
<br />authorized for the cultivation area.
<br />(c) The cultivation area shall not be visible from anywhere outside the
<br />residence. Any windows, skylight, ventilation, or other opening must be
<br />sufficiently covered or opaque as to obscure visibility of the cultivation
<br />area from any adjacent property.
<br />(d) The cultivation area shall not produce odors, sounds, or other emissions
<br />that are detectible from adjacent properties and may indicate marijuana
<br />cultivation.
<br />3. Required Inspection
<br />Prior to the issuance of any RIMC, the applicant shall obtain clearances from the
<br />various city departments based on inspections conducted at the City's discretion,
<br />with prior written consent of the applicant, including, but not limited to, the
<br />following:
<br />(a) Building Official, or designee, and
<br />(b) Fire Marshal, or designee, and
<br />(c) Code Compliance Officer, Police Chief or designee.
