Colton Ordinance No. 0-21-16 <br />1 WHEREAS, the placement of UDCBs has not been expressly regulated by the City; <br />2 and <br />3 <br />WHEREAS, the continued unregulated establishment, installation, placement, <br />4 <br />5 construction and/or expansion of UDCBs will result in increased quantity and intensity of blighted <br />6 conditions; and <br />7 WHEREAS, the City Council now wishes to add Chapter 5.52 to Title 5 (Business <br />8 Licenses and Regulations) to address UDCBs. <br />9 <br />10 NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF COLTON <br />11 HOES ORDAIN AS FOLLOWS: <br />12 SECTION 1: Chapter 5.52 of Title 5 of the Colton Municipal Code is hereby added <br />to read as follows: <br />13 <br />14 Chapter 5.52 UNATTENDED DONATION/COLLECTION BOXES <br />15 Sections: <br />16 <br />5.52.010. Purpose. <br />17 <br />To ensure the prevention of blight and to further public health and safety, it is in the interest <br />18 of the City to prevent the proliferation of unattended donation and collection bins (UDCB) <br />and their placement in required parking spaces, required landscaped areas, and residential <br />19 zoning districts of the City. The proliferation of these UDCBs contribute to visual clutter; <br />and in areas throughout the State, UDCBs have contributed to blight due to graffiti and poor <br />20 maintenance, and the accumulation of debris and excess items outside of the UDCBs. They <br />21 can also interfere with the proper collection of data concerning the diversion of waste within <br />the City from landfills. The purpose of these regulations is to promote the health, safety, <br />22 and/or welfare of the public, and protect the property rights of the owners of the parcels on <br />which the UDCBs are located, by providing minimum blight -related performance standards <br />23 for the operation of UDCBs, including establishing criteria to ensure that (1) material is not <br />24 allowed to accumulate outside of the UDCBs, (2) UDCBs remain free of graffiti and blight, <br />(3) UDCBs are maintained in sanitary conditions, (4) the UDCBs are not placed without the <br />25 approval of property owners, (5) contact information is readily available so that the <br />operators can be contacted if there are any blight -related questions or concerns, and (6) that <br />26 operators properly report information concerning the diversion of materials from landfills. <br />This section regulates the size. number, placement, installation and maintenance of UDCBs, <br />27 as is necessary to accomplish the foregoing purposes. <br />28 <br />-2- <br />
