10 <br />11 <br />12 <br />13 <br />14 <br />15 <br />16 <br />17 <br />18 <br />19 <br />20 <br />21 <br />22 <br />23 <br />24 <br />25 <br />26 <br />27 <br />28 <br />C�7ii 171\%]►C�7 Dl►`[1 1 I <br />AN ORDINANCE OF THE CITY OF COLTON PRESCRIBING <br />TEMPORARY WATER CONSERVATION RULES AND REGULATIONS <br />AND AMENDING TITLE 13, BY ADDING SUBSECTION 13.28.080C <br />WHEREAS, California Constitution article X, section 2 and California Water Code <br />section 100 provide that because of conditions prevailing in the state of California (the <br />"State"), it is the declared policy of the State that the general welfare requires that the water <br />resources of the State shall be put to beneficial use to the fullest extent of which they are <br />capable, the waste, unreasonable use, or unreasonable method of use of water shall be <br />prevented, and the conservation of such waters is to be exercised with a view to the <br />reasonable and beneficial use thereof in the interest of the people and the public welfare, and; <br />WHEREAS, pursuant to California Water Code section 106, it is the declared policy <br />of the State that the use of water for domestic use is the highest use of water and that the next <br />highest use is for irrigation, and; <br />WHEREAS, pursuant to California Water Code section 375, the City of Colton (the <br />"City") is authorized to adopt and enforce a water conservation program to reduce the <br />quantity of water used by persons within its jurisdiction for the purpose of conserving the <br />water supplies of the City, and; <br />WHEREAS, on April 25, 2014, the Governor signed an Executive Order directing the <br />SWRCB to adopt emergency regulations as it deems necessary pursuant to Water Code <br />section 1058.5, to ensure that water suppliers in California implement drought response plans <br />to limit outdoor irrigation and other wasteful water practices, and; <br />WHEREAS, on April 1, 2015, the Governor signed an Executive Order that, in part, <br />directs the SWRCB to impose restrictions on water suppliers to achieve a statewide 25 <br />percent reduction in potable urban usage through February, 2016; require commercial, <br />industrial, and institutional users to implement water efficiency measures; prohibit irrigation <br />with potable water or ornamental turf in public street medians; and prohibit irrigation with <br />potable water outside newly constructed homes and buildings that is not delivered by drip or <br />microspray, and; <br />WHEREAS, on May 5, 2015, the SWRCB formally adopted Emergency Regulations <br />for Statewide Urban Water Conservation ("Emergency Regulations") to enact emergency <br />regulations for water suppliers effective June 1, 2015, and expiring February 28, 2016, unless <br />the SWRCB determines that it is no longer necessary due to changed conditions, or unless the <br />SWRCB renews the regulations due to continued drought conditions as described in Water <br />Code section 1058.5, and; <br />WHEREAS, because of the prevailing conditions in the State, the continued current <br />statewide drought, and the declared policy of the State, the City hereby finds and determines <br />that it is necessary and appropriate for the City to adopt, implement, and enforce temporary <br />water conservation regulations to reduce the quantity of water used by consumers within the <br />City to ensure that there is sufficient water for human consumption, sanitation, and fire <br />protection, and; <br />WHEREAS, pursuant to California Water Code section 350 the City Council is <br />authorized to declare a water shortage emergency to prevail within its jurisdiction when it <br />finds and determines that the City will not be able to or cannot satisfy the ordinary demands <br />and requirements of water consumers without depleting the water supply of the City to the <br />NibFg4pti$o tge%pyould be insufficient water_ for human consumption, sanitation, and fire <br />
