rd <br />10 <br />11 <br />12 <br />13 <br />14 <br />15 <br />16 <br />17 <br />18 <br />19 <br />20 <br />21 <br />22 <br />23 <br />24 <br />25 <br />26 <br />27 <br />M <br />ORDINANCE NO. 0-09-14 <br />AN ORDINANCE OF THE CITY OF COLTON PRESCRIBING WATER <br />CONSERVATION RULES AND REGULATIONS AND AMENDING TITLE 13, BY <br />ADDING CHAPTER 13.28 <br />WHEREAS, California Constitution article X, section 2 and California Water Code section <br />100 provide that because of conditions prevailing in the state of California (the "State"), it is <br />the declared policy of the State that the general welfare requires that the water resources of <br />the State shall be put to beneficial use to the fullest extent of which they are capable, the <br />waste or unreasonable use of water shall be prevented, and the conservation of such waters is <br />to be exercised with a view to the reasonable and beneficial use thereof in the interest of the <br />people and the public welfare; and <br />WHEREAS, pursuant to California Water Code section 106, it is the declared policy of the <br />State that the use of water for domestic use is the highest use of water and that the next <br />highest use is for irrigation; and <br />WHEREAS, pursuant to California Water Code section 375, the City of Colton (the "City") <br />is authorized to adopt and enforce a water conservation program to reduce the quantity of <br />water used by persons within its jurisdiction for the purpose of conserving the water supplies <br />of the City; and <br />WHEREAS, on April 25, 2014, the Governor signed an Executive Order directing the <br />State Water Resource Control Board (SWRCB) to adopt emergency regulations as it deems <br />necessary pursuant to Water Code section 1058.5, to ensure that water suppliers in California <br />implement drought response plans to limit outdoor irrigation and other wasteful water <br />practices; and <br />WHEREAS, on July 15, 2014, the SWRCB formally adopted Emergency Regulations <br />for Statewide Urban Water Conservation ("Emergency Regulations") to enact emergency <br />regulations for water suppliers effective July 28, 2014, and expiring 270 days thereafter, <br />unless the SWRCB determines that it is no longer necessary due to changed conditions, or <br />unless the SWRCB renews the regulations due to continued drought conditions as described <br />in Water Code section 1058.5; and <br />WHEREAS, the SWRCB Emergency Regulations prohibit certain types of water use; <br />WHEREAS, the SWRCB Emergency Regulations urban water suppliers (as set forth <br />in Water Code section 10617) to take action to either: (1) implement all requirements and <br />actions of its water shortage contingency plan that imposes mandatory restrictions on outdoor <br />irrigation of ornamental landscapes or turf with potable water; or (2) submit an alternate plan <br />that includes allocation -based water rate structures that satisfy the requirements of chapter 3.4 <br />(commencing with section 370) of division 1 of the Water Code; and <br />- 1 - <br />
