1 <br />2 <br />3 <br />4 <br />5 <br />6 <br />7 <br />8 <br />9 <br />10 <br />11 <br />12 <br />13 <br />14 <br />15 <br />16 <br />17 <br />18 <br />19 <br />20 <br />21 <br />22 <br />23 <br />24 <br />25 <br />26 <br />27 <br />28 <br />ORDINANCE NO. 0-04-13 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF COLTON <br />TO AMEND TITLE 18, CHAPTER 18.50 OF THE COLTON <br />MUNICIPAL CODE RELATING TO TEMPORARY PROMOTIONAL <br />SIGNS AND POLITICAL SIGNS (FILE INDEX NO.: DAP -001-082) <br />WHEREAS, the Planning Commission of the City of Colton ("Planning Commission") <br />initiated an application to amend Chapter 18.50 of Title 18 of the Colton Municipal Code ("Sign <br />Ordinance"), as allowed by Section 18.58.050.A.2. of the Colton Municipal Code, to clarify and <br />update existing code sections related to temporary signs; and <br />WHEREAS, on October 18, 2011, the City Council adopted the Year -Round Temporary <br />Promotional Sign Ordinance No. 0-06-11 which became effective on November 18, 2011 and <br />was valid for one year; and <br />WHEREAS, during the City Council's consideration of the Year -Round Temporary <br />Promotional Sign Ordinance No. 0-06-11, the Council gave direction to staff to address political <br />sign standards following the general elections in November 2012. This direction was reaffirmed <br />by the City Council in April 2012, during public hearings on technical updates to the sign <br />ordinance; and <br />WHEREAS, on July 23 and August 13, 2013, the Planning Commission held a duly <br />noticed public hearing regarding an ordinance to amend the Sign Ordinance (the "Ordinance") to <br />consider refinements to temporary promotional signage regulations and political sign regulations; <br />and <br />WHEREAS, on August 13, 2013, the Planning Commission adopted Resolution No. R- <br />16-13, recommending that the City Council amend the Ordinance relating to temporary <br />promotional signs and political signs; and <br />WHEREAS, the City Council wishes to adopt the Ordinance to maximize additional <br />temporary promotional signage opportunities for City businesses by allowing the placement of <br />temporary promotional signs within the public right-of-way under specified conditions, and to <br />clarify standards for political signs; and <br />WHEREAS, on September 17, 2013, the City Council of the City of Colton ("City <br />Council") held a duly noticed public hearing at which time all persons wishing to testify in <br />connection with the Ordinance were heard and the Ordinance was comprehensively reviewed; <br />and <br />WHEREAS, all other legal prerequisites to the adoption of this Ordinance have occurred. <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF COLTON DOES <br />ORDAIN AS FOLLOWS: <br />SECTION 1. Incorporation of Recitals. The City Council hereby adopts the recitals <br />forth above in connection with this Ordinance. <br />SECTION 2. Section 18.50.030 - Definitions of Title 18 of the Colton Municipal Code, <br />
