General Plan Consistency. Based on the entire record before the City <br />Council and all written and oral evidence presented, including the staff report and the findings <br />made in this Ordinance, the City Council hereby finds and determines that the proposed <br />Ordinance is consistent with the goals and policies of the City of Colton General Plan and is <br />reasonably related to the public welfare of the citizens of the City and surrounding regions. <br />Specifically, the provisions of this Ordinance make clear the zones in which various uses not <br />previously included in the Zoning Ordinance are conditionally permitted. <br />In addition, the requirement for a conditional use permit for uses associated with second <br />hand/resale stores, 24-hour retail or restaurant operations, private transportation facilities, and <br />swap meets (indoor & outdoor) in various Zones within the City of Colton furthers the City's <br />goals and policies as set forth in the City of Colton General Plan, specifically: <br />Land Use Element. Requiring a conditional use permit for uses associated with <br />second hand/resale store, 24-hour retail or restaurant operations, private transportation <br />facilities and swap meets (indoor & outdoor) upholds the General Objectives and Commercial <br />Standards of the City's current Land Use Element, specifically: <br />o General Objective 1: To create a land use pattern which provides a safe, <br />harmonious and attractive residential living environment. <br />o Commercial Standard 2: Commercial designations shall allow flexibility in <br />determining development types deemed necessary to establish a healthy and well- <br />balanced commercial community. <br />Finally, the City of Colton finds that the proposed Zone Text Amendment requiring a <br />conditional use permit is reasonably related to the public welfare of the citizens of the City <br />and surrounding region; more specifically, Section 18.58.060(A) in the Colton Municipal <br />Code states that, "The purpose of a conditional use pen -nit is to allow certain uses that <br />contribute to the orderly growth and development of the city to be properly integrated into the <br />overall community pattern and zone where located." The provisions of this Ordinance make <br />clear the zones in which various uses not previously included in the Zoning Ordinance are <br />pennitted. <br />SECTION 3. Section 18.04.389 is hereby added to Chapter 18.04 of Title 18 of the <br />Colton Municipal Code, to read as follows: <br />"18.04.389 Resale/secondhand stores. <br />"Resale/secondhand stores" means retail store that re -sells products or materials that <br />have been previously owned by a third party, other than a wholesaler or original <br />fabricator. Resale/secondhand stores shall include pawn shops or consignment shops <br />that sell products or materials currently owned by a third party. Resale of raw <br />materials, such as gold and/or silver, shall be included in said definition." <br />-2- <br />
