Section 18.50.020 of Title 18 of the Colton Municipal Code is <br />amended and replaced in its entirety to read as follows: <br />18.50.020 - Interpretation and substitution of text. <br />A. The provisions of this chapter shall not be interpreted to nullify any easements, covenants <br />or other private agreements which provide for more restrictive sign regulations than are <br />required by this chapter. <br />B. The development services director is authorized and directed to enforce and administer the <br />provisions of this chapter. Whenever the application of this chapter is uncertain due to <br />ambiguity of its provisions, the issue shall be referred to the development services director <br />for a determination. Such determination shall be made within ten days. Any decision made <br />by the development services director may be appealed to the planning commission in <br />accordance with Section 18.50.040(F) of this chapter. <br />C. It is the city's policy and intent to regulate both commercial and noncommercial signs in a <br />viewpoint -neutral or content -neutral manner. The message of the sign shall not be <br />reviewed except to the minimum extent necessary to identify the type of sign. <br />D. In each instance and under the same conditions to which this chapter permits any sign, a <br />sign containing an ideological, political or other noncommercial message that is <br />constructed to the same physical dimensions of the permitted sign shall be permitted. <br />E. Within this chapter, the distinction between on -premise and off -premise applies to <br />commercial messages. <br />F. Signs not expressly permitted by this chapter are prohibited. <br />SECTION 4. Section 18.50.030 of Title 18 of the Colton Municipal Code is hereby <br />amended and replaced in its entirety to read as follows: <br />18.50.030 — Definitions. <br />For purposes of this chapter, the following terms shall have the provided definitions: <br />"Abandoned advertising display" or "abandoned sign" means any display or sign <br />remaining in place or not maintained for a period of ninety days, which no longer identifies an <br />ongoing business, product or service available on the business premises where the display or sign <br />is located or where the building, business or establishment to which the display or sign is related <br />has ceased operation. For purposes of this definition, abandonment for the applicable ninety -day <br />period shall be deemed conclusive evidence of abandonment regardless of the property, business <br />or sign owner's intent. <br />-2- <br />
