eliminate and prevent blight (including remediation of buildings and structures that are unhealthy or <br />unsafe to occupy or properties affected by hazardous substances), stimulate and expand economic <br />growth in the Project Areas, create and develop job opportunities within the City and alleviate <br />deficiencies in public infrastructure within the City. <br />(c) Blighting conditions in the Project Areas constitute substantial threats <br />to the public peace, health and safety, and are so prevalent that they cannot be eliminated without <br />Agency action, including implementation of Agency programs and expenditure of tax increment <br />revenue of the Agency. <br />(d) During the current economic crisis, the City needs the Agency to <br />immediately continue the Agency's redevelopment activities in the Project Areas. As of May 2011, <br />the unemployment rate in the City is approximately 14.2%, compared with 13.2% for San Bernardino <br />County, 11.4% for the State of California and 8.7% for the nation. The following activities of the <br />Agency are necessary for the City to continue to combat high unemployment: Acquiring land for <br />projects to generate local job creation, business expansion and/or retention; building or rehabilitating <br />infrastructure; making low-cost loans to small businesses for physical improvements to their <br />properties; clearing existing blight or environmental hazards that make projects infeasible; improving <br />quality of life by building or rehabilitating libraries, parks and community centers; improving public <br />safety and reducing crime by building police and fire stations; building affordable housing; and funding <br />the rehabilitation of existing housing for working families. <br />(e) The Agency is actively engaged in efforts to rehabilitate housing units, <br />provide assistance for property improvements and provide safe and affordable housing. Adoption of <br />this Urgency Ordinance will permit the Agency to continue these housing efforts within the City <br />immediately. <br />Section 4. Participation in the Alternative Voluntary Redevelopment Program. In <br />accordance with Health and Safety Code Sections 34192, et seq., subject to the conditions and <br />reservations set forth in this Urgency Ordinance, the City Council hereby determines that the City <br />shall participate in the Alternative Voluntary Redevelopment Program for Fiscal Year 2011-2012 and <br />subsequent fiscal years, subject to annual City budget appropriations and the City Council's reserved <br />legislative discretion and other rights, and pay the community remittance amounts payable pursuant to <br />California Health and Safety Code Section 34194. The City's participation in the Alternative <br />Voluntary Redevelopment Program, including all community remittance payments made related to <br />such program shall be under protest, subject to the City's reserved rights and without prejudice to <br />the City's right to recover any or all amounts of such payments and interest on the amounts of such <br />payments in the future, if all or any portion of California Health and Safety Code Sections 34161, et <br />seg., or California Health and Safety Code Sections 34192, et seq., are determined by a court of <br />competent jurisdiction to be unconstitutional, illegal, invalid or otherwise unenforceable or <br />inapplicable, for any reason or in any manner. <br />Section 5. Statement of Additional Intent. The intent ofthe City Council is that, once <br />the Agency is again authorized to enter into agreements under the California Community <br />Redevelopment Law, the City will enter into an agreement with the Agency, as authorized pursuant to <br />California Health and Safety Code Section 34194.2, whereby the Agency will transfer a portion ofthe <br />2 <br />
