2022 FEBRUARY 16 CC/CUA/CPFA/CHA MEETING 3 - <br /> <br />Council Discussion <br />Discernment and discussion between Mayor and Councilmembers present, with clarification provide by staff: <br />Manager Elshof; and Director DeLoach. <br /> <br />Motion and Second by CM Suchil/CM González to approve and adopt Resolution No. R-14-21. <br />Vote: Motion carried with CM Toro absent. <br /> <br />BUSINESS ITEMS <br /> <br />(2) Ordinance - Fireworks - Waive Full Reading, Read By Title Only and Pass First Reading of an <br />Ordinance of the City Council of the City of Colton, California, Amending Chapter 6.32 of the Colton <br />Municipal Code Regarding The Sale, Purchase, and Use of Fireworks, ORDINANCE NO. O-02-21. <br /> <br />Staff Presentation <br />Fire Chief McHargue and Associate Sara Levine, BB&K presented for Council consideration an overview of <br />the agenda item and requested approval of staff’s recommendation. <br /> <br />Public Comment <br />None <br /> <br />Council Discussion <br />Discernment and discussion between Mayor and Councilmembers present, with clarification provide by staff: <br />Fire Chief McHargue; Associate Levine; City Attorney Campos; and City Manager Smith <br /> <br />Motion and Second by CM Suchil/MPT Cisneros to waive full reading, read by title only and introduce <br />Ordinance No. O-02-21 with the following modifications/changes: <br /> <br /> No fireworks booths to be located within one mile of Cal-Fire designated Very High Fire Hazard <br />Severity Zones located within the City of Colton. <br /> <br /> Administrative fines to include a disposal fee similar to Article 20. Disposal of Fireworks, Section 4 <br />Administrative Fines, A <br /> <br />$3,000 fine $1,000 Disposal Charge (33% of fine amount) <br />$5,000 fine $1,650 Disposal Charge (33% of fine amount [based on percentage <br />of fine calculation]) <br />**Disposal Charges should not be added to any fines issued to individuals from whom fireworks are not seized. <br /> <br />Vote: Motion carried with CM Toro absent; CM González voting NO. <br /> <br />*************************************************************************** <br />Public Comment <br />The following community members addressed the Council: Tom Elliff (electronic correspondence). <br /> <br />*************************************************************************** <br /> <br />CONSENT CALENDAR <br />Mayor Navarro presented the Consent Calendar Items 3 through 9. <br /> <br />Councilmembers present selected items for discussion and clarification by staff: CM Suchil, Item 7.
