ill <br />2' <br />3 <br />4 <br />5 <br />6 <br />7 <br />8 <br />9 <br />10 <br />11 <br />12' <br />13 <br />14 <br />15 <br />16 <br />17 <br />18 <br />19 <br />20 <br />21 <br />22 <br />23 <br />24 <br />25 <br />2E <br />2'1 <br />2F <br />ORDINANCE NO. 1609 <br />ORDINANCE OF THE CITY COUNCIL OF THE CITY OF COLTON <br />APPROVING THE TERAS AND CONDITIONS OF A POWER SALES <br />CONTRACT BETWEEN SOUTHERN CALIFORNIA PUBLIC POWER <br />AUTHORITY AND THE CITY OF COLTO�4 AND AUTHORIZING <br />THE EXECUTION OF AND DELIVERY OF SAID AGREEMENT BY <br />OFFICERS OF THE CITY OF COLTON. <br />WHEREAS, pursuant to the provisions of Chapter 5, Division 7, <br />Title 1 of the government Code of the State of California, as a,ended (the <br />"Joint Powers Act"), the City of Colton and certain other public agencies <br />created pursuant to the laws of the State of California (collectively; the <br />"Members"), have entered into a Joint Powers Agreement (the "Agreement") <br />creating the Southern California Public Power Authority (the "Authority"), <br />a public entity separate and apart from the (Members; and <br />WHEREAS, in accordance with the Agreement and the Joint Powers Act, <br />the Authority has entered or will enter into agreements to acquire an interest <br />in a project for the generation of electric energy, which project (the "Project" <br />is to consist of an ownership interest as tenant in common in the Palo 'verde <br />Nuclear Generating Station, a nuclear steam electric generating station under <br />construction in the State of Arizona, and capital improvements thereto that <br />may be constructed from tiri,e to time, and interests in certain other properties <br />and rights relating thereto; and <br />vIHEREAS, the City of Colton has need for an economical, reliable <br />source of electric power and energy to meet the demands of the customers of its <br />electric system, and, as such, has determined that it is desirable to enter <br />into a Power Sales Contract (the "Power Sales Contract") in the form subii„itted <br />to this City Council and dated for convenience as of July 1, 1981, to purchase <br />electric capacity and energy of the Project from the Authority; and, <br />'WHEREAS, this City Council finds and determines that it is in the <br />best interests of the customers of the electric system of the City of Colton <br />for the City of Colton to purchase electric capacity and energy of the Project <br />from the Authority. <br />NOW, THEREFORE, the City Council of the City of Colton does ordain <br />as follows: <br />1. The City Council hereby finds and determines that <br />the terms and conditions of the Pov4er Sales Contract, <br />including the Project Entitlement Share of the City of <br />Colton of 1.000% be, and the same are hereby, approved. <br />
