R-120-90, and <br />R-121-90 on October 30, 1990, and adoption of Resolution No. <br />R-126-90 on November 6, 1990 the City Council of the City of <br />Colton (the "City Council") established Community Facilities <br />District No. 90-1 (Mount Vernon Corridor) of the City of Colton <br />(the "CFD"), authorized the levy of a special tax, as defined <br />below, on all non- exempt real property within the boundaries of <br />the CFD and determined the necessity to incur bonded indebtedness <br />in an amount not to exceed $10,000,000, in accordance with all <br />applicable notice and hearing requirements of the Mello -Roos <br />Community Facilities Act of 1982, as amended (Section 53311 and <br />following of the Government Code of the State of California) (the <br />"Act"); and <br />WHEREAS, the special tax proposed to be levied on all <br />non-exempt real property within the boundaries of the CFD to pay <br />for the principal of, premium, if any, and interest on bonds <br />issued by the CFD and to pay for the costs of equipping, acquiring <br />and/or constructing all the proposed facilities has not, pursuant <br />to Section 53324 of the Act, been eliminated by protest by fifty <br />percent (50%) or more of the registered voters or six registered <br />voters, whichever is more, residing within the territory of the <br />CFD or the owners of one-half (1/2) or more of the area of land, <br />
