O- 0 5 - 9 6 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br />COLTON GRANTING A FRANCHISE TO TCI CABLEVISION OF <br />CALIFORNIA, INC. PURSUANT TO CHAPTER 5.06 OF THE <br />COLTON MUNICIPAL CODE RELATING TO CABLE <br />TELEVISION <br />THE CITY COUNCIL OF THE CITY OF COLTON ORDAINS AS FOLLOWS: <br />SECTION 1: Pursuant to Section 5.06.210(C) of the Colton Municipal Code the <br />franchise agreement (the "Franchise Agreement") between the City of Colton ("City") and TCI <br />Cablevision of California, Inc. ("TCI") which is set forth as Exhibit A hereof and which is <br />incorporated herein as though set forth in full, is hereby adopted as an uncodified ordinance of <br />the City granting a franchise to TCI in accord with all the terms and conditions of Chapter 5.06 <br />of the Colton Municipal Code. <br />SECTION 2: As one of the mandatory and express conditions applicable to the <br />Franchise Agreement pursuant to Section 5.06.210(D)(1) of the Colton Municipal Code, the <br />franchise granted by this ordinance shall be used and operated solely and exclusively for the <br />purpose expressly authorized by ordinance of the City and no other purpose whatsoever. <br />SECTION 3: If any provisions of this Ordinance or application thereof to any person <br />or circumstances is held invalid, this invalidity shall not affect other applications of this <br />Ordinance which can be given effect without the invalid provision or applications, and to this <br />end, the provisions of this Ordinance are declared to be severable. This Ordinance shall be <br />liberally construed to achieve the purposes of this Ordinance and to preserve its validity. <br />
