Title 2 of the Colton Municipal Code is hereby amended by adding a new Chapter 2.19 to read as <br />follows: <br />"Chapter 2.19 <br />Section 2.19.0 10 Human Resources Director Authorization to Execute Contracts <br />Section 2.19.010 Authorization to Execute Contracts. This Section applies to any settlement agreement <br />between the City and existing or terminated employees' contract or agreement ("Contract") between the City and <br />the provider of professional services, including medical, dental, or vision, which services are provided to the <br />City's employees as part of the City's benefits packages. Contract shall be effective unless approved by the vote <br />of the City Council or otherwise approved in a manner consistent with this Section 2.19.010. <br />In accordance with California Goverrinient Code Section 40602, the Mayor shall execute all Contracts made or <br />entered into by the City, unless another City officer or employee is authorized to execute such Contract pursuant <br />to this Code or ordinance adopted by the City Council. The Human Resources Director is hereby authorized to <br />sign the following types of Contracts made or entered into by the City: <br />Council-, <br />1. Contracts approved by a majority vote of the City Council; <br />2. Settlement agreement Contracts approved by a majority vote of the City Council; <br />3. Amendments to Contracts where such amendments are approved by a majority vote of the City <br />All Contracts executed by the Human Resources Director shall be attested to by the City Clerk. <br />No person other than the Mayor, the City Manager or other person expressly authorized by this Code or <br />other ordinance may bind the City. Any purported Contract not executed in conformity with this Code or <br />ordinance is void and shall not be the subject of implied ratification or estoppel, unless expressly ratified by <br />resolution duly adopted by the City Council." <br />
