R- 18- 91 <br />A RESOLUTION OF THE CITY COUNCIL OF THE <br />CITY OF COLTON, CALIFORNIA, MAKING CERTAIN <br />FINDINGS WITH RESPECT TO THE RATE AND <br />METHOD OF APPORTIONMENT OF THE SPECIAL TAX <br />WITHIN COMMUNITY FACILITIES DISTRICT NO. <br />90-1 (MOUNT VERNON CORRIDOR) OF THE CITY <br />OF COLTON, COUNTY OF SAN BERNARDINO, CALI- <br />FORNIA, AND WAIVING CERTAIN REQUIREMENTS <br />SET FORTH IN A FUNDING, CONSTRUCTION AND <br />ACQUISITION AGREEMENT RELATING TO SAID <br />COMMLTNITY FACILITIES DISTRICT <br />WHEREAS, the City Council (the "City Council") of the <br />City of Colton (the "City") has previously conducted proceedings, <br />pursuant to Chapter 2.5 (commencing with Section 53311) of Part 1 <br />of Division 2 of Title 5 of the California Government Code, <br />commonly known as the Mello-Roos Community Facilities Act of 1982 <br />(the "Act") and in accordance therewith has adopted Resolution No. <br />R-120-90, the resolution of formation of Community Facilities <br />District No. 90-1 (Mount Vernon Corridor) of the City of Colton, <br />County of San Bernardino, State of California (the "Community <br />Facilities District"), establishing the Community Facilities <br />District and the boundaries thereof; and <br />WHEREAS, pursuant to the Act, the City Council has also <br />adopted a rate and method of apportionment of the special tax as <br />set forth in Exhibit "C" to Resolution No. R-120-90 (the "Rate and <br />Method of Apportionment") setting forth the manner and the rates <br />at which the special tax shall be levied on all non exempt real <br />property within the boundaries of the Community Facilities <br />District; and <br />
