1 RESOLUTION NO. R-39-92 <br />2 <br />A RESOLUTION OF THE CITY COUNCIL <br />3 OF THE CITY OF COLTON PROVIDING FOR <br />WORKERS' COMPENSATION COVERAGE FOR <br />4 VOLUNTEER PERSONNEL <br />5 WHEREAS, the City of Colton utilizes the services of <br />6 <br />npaid volunteers in positions within a number of its <br />7 <br />departments; and <br />8 WHEREAS, Section 3363.5 of the California Labor Code <br />9 provides that a person who performs voluntary service without <br />10 <br />ay for a public agency as designated and authorized by the <br />11 <br />overning body of the agency of its designee, shall, upon <br />12 <br />adoption of a resolution by the governing body of the agency so <br />13 <br />declaring, be deemed to be an employee of the agency for the <br />14 <br />urpose of Division 4 of said Labor Code while performing such <br />15 services; and <br />16 WHEREAS, Section 3363.5 of the Labor Code defines <br />17 'voluntary service without pay" to include those services <br />18 performed by any person who receive no remuneration other than <br />19 meals, transportation, lodging or reimbursement for incidental <br />20 expenses; and <br />21 WHEREAS, the Mayor and City Council wish to extend <br />22 Workers' Compensation coverage as provided by state law to <br />23 hose persons proving voluntary services without pay to the <br />24 city; <br />25 NOW, THEREFORE BE IT RESOLVED by the Mayor and Council of <br />26 he City of Colton, as follows: <br />27 That persons who perform voluntary service without pay <br />28 re considered to be employees of the City of Colton solely and <br />
