1 RESOLUTION NO. R-]30-93 <br />2 <br />RESOLUTION OF THE CITY COUNCIL <br />3 OF THE CITY OF COLTON <br />ORDERING FORECLOSURE ACTIONS AND <br />4 APPROVING SPECIAL COUNSEL AGREEMENT <br />5 <br />6 WHEREAS, the City Council of the City of Colton, California, ("CITY"), has <br />7 heretofore undertaken proceedings pursuant to the "Mello -Roos Community Facilities Act of <br />8 1982", being Chapter 2.5, Part 1, Division 2, Title S of the Government Code ("ACT") of the <br />9 State of California, and has levied special taxes upon lands within a Special Community <br />10 Facilities Districts described in Resolutions of Intention previously adopted for said <br />11 improvements, said Special Community Facilities Districts being designated as Community <br />12 Facilities District No. 90-1 ("DISTRICT"); and, <br />13 WHEREAS, said proceedings provided for the issuance of bonds pursuant to the ACT <br />14 and said bonds were previously issued; and <br />15 WHEREAS, collection of all special taxes levied pursuant to said DISTRICT <br />16 proceedings were and are intended to provide timely payment of all amounts or principal and <br />17 interest due and payable pursuant to the terms of the above -referenced bonds; and, <br />18 WHEREAS, certain owners of property within the DISTRICT have become delinquent <br />19 in the payment of said special taxes, thereby necessitating the institution of foreclosure actions <br />20 with respect to such parcels. <br />21 NOW, THEREFORE, it is hereby resolved as follows: <br />22 Section 1. That the above recitals are true and correct. <br />23 Section 2. That it is hereby ordered that all delinquent special taxes within the <br />24 DISTRICT be collected by actions brought in the Superior Court to foreclose the liens thereof <br />25 in accordance with the ACT, and this order is made pursuant to §53356.1 of the California <br />26 Government Code. That is is hereby further ordered that, in the event that any special taxes <br />27 levied in the future within the DISTRICT, become delinquent, such delinquencies shall be <br />28 collected in the same manner and the Treasurer of the CITY shall provide a Notice to Proceed <br />
