1 RESOLUTION NO. R-35-95 <br />2 A RESOLUTION OF THE CITY OF COLTON RESOLUTION <br />TO GRANT ONE TO FOUR YEARS ADDITIONAL SERVICE <br />3 CREDIT <br />4 <br />5 WHEREAS, the City of Colton is a contracting public Agency of the Public Employees' <br />6 Retirement System; and <br />7 WHEREAS, California Government Code Section 20821.6 provides that when the governing <br />body of a contracting agency determines that because of an impending curtailment <br />8 of, or change in the manner of performing service, the best interests of the <br />agency would be served by encouraging the retirement of local members, the <br />9 governing body may adopt a resolution to grant eligible employees one to four <br />years additional service credit when certain conditions specified in said section <br />10 exist; and <br />11 <br />WHEREAS, said Section requires the governing body to specify the number of whole years of <br />12 additional service credit being granted and to determine a period in which eligible <br />members, who meet the conditions, must retire to be entitled to receive said <br />13 credit; and <br />14 <br />WHEREAS, said period may begin as early as one day following, and end not more than 120 <br />15 days following, the governing body's adoption of the resolution; and <br />16 <br />WHEREAS, said Section requires the governing body to designate the categories of eligible <br />17 members and allows for eligibility to be limited to members employed in specific <br />18 Department(s), Program(s) and/or position classifications within said Agency; <br />19 NOW, THEREFORE, BE IT RESOLVED, that the City Council, as governing body of the City <br />of Colton has determined that because of an impending curtailment of service, or <br />20 change in the manner of performing service, the best interests of the Public <br />Agency would be served by encouraging the retirement of local members and <br />21 desires to provide four years additional service credit pursuant to Section 20821.6 <br />22 for eligible local miscellaneous members. <br />23 BE IT FURTHER RESOLVED, that said governing body determines that the period in which <br />eligible members, who meet the conditions, must retire to be entitled to the <br />24 additional credit shall begin on May 3, 1995 and end on June 30, 1995 and that <br />to be entitled to the additional credit, eligible members, who meet the conditions, <br />25 must be employed in any Program, any Department and any position classification <br />26 of the City of Colton on the date of adoption of this Resolution. <br />27 <br />28 1 <br />
