R-41-95 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COLTON <br />EXEMPTING RESIDENTIAL PROPERTY OWNERS IN COMMUNITY <br />FACILITIES DISTRICTS FROM PAYMENT OF THE UTILITY USERS <br />TAX ESTABLISHED UNDER URGENCY ORDINANCE NO. 0-04-95 <br />WHEREAS, the City Council has adopted Urgency Ordinance No. 0-04-95, <br />implementing a Utility Users Tax; and, <br />WHEREAS, property owners in residential community facilities districts carry a <br />substantial tax burden imposed by the City to cover the cost of public infrastructure, parks and <br />other community facilities of benefit to the entire City of Colton as well as to the residents of <br />the communities facilities districts; and <br />WHEREAS, property owners or residents in whose name bills for utilities services are <br />rendered for properties within community facilities districts directly or indirectly carry a tax <br />greater burden than that imposed in other residential areas within the City thereby increasing <br />monthly housing costs to residents substantially; and <br />WHEREAS, the City Council in adopting Urgency Ordinance No. 0-04-95 has <br />determined that imposition of the utility users tax on those persons paying for utilities services <br />on property located within a communities facilities district will cause undue hardship by <br />increasing monthly housing costs that are already extraordinarily high because of the <br />substantially greater tax burden being carried directly or indirectly by these residents; and <br />WHEREAS, the City Council, pursuant to the provisions of Section 3.40.180 of the <br />Colton Municipal Code, as enacted by Ordinance No. 0-04-95, has the authority to exempt one <br />or more classes of persons subject to payment of the utility users tax. <br />
