R-41-95 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COLTON EXEMPTING RESIDENTIAL PROPERTY OWNERS IN COMMUNITY FACILITIES DISTRICTS FROM PAYMENT OF THE UTILITY USERS TAX ESTABLISHED UNDER URGENCY ORDINANCE NO. 0-04-95 WHEREAS, the City Council has adopted Urgency Ordinance No. 0-04-95, implementing a Utility Users Tax; and, WHEREAS, property owners in residential community facilities districts carry a substantial tax burden imposed by the City to cover the cost of public infrastructure, parks and other community facilities of benefit to the entire City of Colton as well as to the residents of the communities facilities districts; and WHEREAS, property owners or residents in whose name bills for utilities services are rendered for properties within community facilities districts directly or indirectly carry a tax greater burden than that imposed in other residential areas within the City thereby increasing monthly housing costs to residents substantially; and WHEREAS, the City Council in adopting Urgency Ordinance No. 0-04-95 has determined that imposition of the utility users tax on those persons paying for utilities services on property located within a communities facilities district will cause undue hardship by increasing monthly housing costs that are already extraordinarily high because of the substantially greater tax burden being carried directly or indirectly by these residents; and WHEREAS, the City Council, pursuant to the provisions of Section 3.40.180 of the Colton Municipal Code, as enacted by Ordinance No. 0-04-95, has the authority to exempt one or more classes of persons subject to payment of the utility users tax.
