R- 137-96 <br />RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />COLTON APPROVING DISCRETIONARY PROVISION OF <br />LEGAL DEFENSE TO GEORGE FULP <br />WHEREAS, the City Council took action on November 5, 1996 to provide legal defense <br />to George Fulp, Mayor of the City of Colton, in an action filed against him prior to his <br />assumption of public office known as Turner v. Fulp, SCV 17724; and <br />WHEREAS, it was determined by the City Council in taking this action that it had <br />discretion pursuant to the provisions of California Government Code Section 995.9 to provide <br />such legal defense even though the facts alleged in the case concern actions taken before formal <br />employment of Mr. Fulp as Mayor of the City of Colton; and <br />WHEREAS, in its discretion, the City Council set a maximum limit of expenditures to <br />defend Mr. Fulp in this matter at $88,000; and <br />WHEREAS, subsequent to the action taken by the City Council, a check in the amount <br />of $48,977.10 was issued to the law firm of Reid and Hellyer in order to implement the action <br />taken by the City Council; and <br />WHEREAS, in order to properly document the action taken by the City Council, the <br />Council now wishes to adopt this Resolution setting forth findings relating to the action taken. <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF COLTON HEREBY <br />RESOLVES AS FOLLOWS: <br />SECTION 1 <br />The City Council ratifies the action taken on November 5, 1996 and notes <br />that that action was taken based upon the following findings: <br />
