R- 2-97 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COLTON <br />ESTABLISHING A DEDICATED SOURCE OF REVENUE FOR THE <br />REPAYMENT OF STATE REVOLVING FUND LOANS NO. <br />C-06-4122-120 FOR THE COLTON/SAN BERNARDINO RAPID <br />INFILTRATION EXTRACTION (RIX) PROJECT AND NO. <br />C-06-4100-120 FOR THE COLTON/SAN BERNARDINO RIX <br />DEMONSTRATION PROJECT <br />WHEREAS, the City of Colton has received State Revolving <br />Fund loans from the State Water Resources Control Board for the <br />purpose of constructing a Rapid Infiltration Extraction (RIX) <br />demonstration project, and a RIX regional tertiary treatment project; and <br />WHEREAS, the State Water Resources Control Board requires <br />the dedication of a source of revenue for repayment of the loans; and <br />WHEREAS, the RIX Demonstration project was successful; and <br />WHEREAS, the full-scale RIX facilities have been constructed <br />and are now operational; and <br />WHEREAS, the City of Colton collects revenue via sewer <br />charges for use of the City's wastewater treatment system. <br />NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS: <br />SECTION 1. The revenue <br />of the sewer <br />fund <br />of the City of <br />Colton shall be dedicated to the <br />repayment of <br />any <br />and all State <br />Revolving Fund loans on Projects No. C-06-4100-120 and C-06-4122- <br />120. This dedicated source of revenue shall remain in effect until such <br />loans are fully discharged, unless modification or change of such <br />dedication is approved in writing by the State Water Resources Control <br />I:•, of <br />
