R-53-00 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />COLTON DECLARING AN EMERGENCY AND DELEGATING <br />AUTHORITY TO THE UTILITY DIRECTOR TO ORDER <br />ACTIONS REQUIRED TO REPAIR A SEWER MAIN ON <br />WESTERN AVENUE <br />WHEREAS, Section 22050 of the State Public Contract Code governs <br />emergency contracting procedures applicable to the City of Colton. Section 22050 of <br />the Public Contract Code allows the Council to pass a resolution by a four-fifths vote <br />of its membership declaring that emergency conditions existed and delegating <br />authority to order actions required by that emergency without giving notice for bids to <br />let contracts. <br />WHEREAS, the Colton City Council finds emergency conditions existed on <br />Norman Road to insure the health and safety of the public. <br />NOW, THEREFORE, BE IT RESOLVED that the City Council resolves as <br />follows: <br />1. Thomas K. Clarke, Utility Director, is delegated the authority to order <br />materials and labor to install a sewer main on Western Avenue, <br />authorized by Section 22050 of the Public Contract Code to respond to <br />the emergency. <br />PASSED, APPROVED and ADOPTED this 20th day of June, 2000. <br />DEIRDRE H.
