R-44-22 <br />APPROVE THE AMENDMENT TO THE CONTRACT WITH DIVERSIFIED <br />UTILITY SERVICES, INC. FOR THE AMOUNT NOT TO EXCEED $102,060.06 <br />(INCLUDING THE ADDED 10,886.06 CHANGE ORDER) IN ACCORDANCE <br />WITH SECTION 3.08.060(I) FOR EMERGENCY REPAIRS AS DESCRIBED IN <br />CODE SECTION 22050 <br />WHEREAS, on January 121h, 2021 Century Substation Transformer sub tripped offline <br />due line arcing; and <br />WHEREAS, the critical infrastructure is in need of emergency repair as soon as possible <br />to mitigate outage and safety risks that increase during the summery months; and <br />WHEREAS, as required by Colton Municipal Code Section 3.08.130(a), the City <br />Manager has the authority to declare a public Emergency and take any directly related and <br />immediate action required by the Emergency, up to a total of one hundred thousand dollars" and <br />staff sought offers for the job selecting an offer for less than one hundred thousand dollars; and <br />WHEREAS, in compliance with the requirements in the City's Municipal Code, Section <br />3.08.130, City Council must ratify the approved emergency repair work around the Mt. Vernon <br />and M Street area without a formal bid process. <br />WHEREAS, City staff was notified on April 19th that a change order for wire supplies is <br />required adding $10,886.06 to the total cost of the contract and in accordance with Colton <br />Municipal Code 3.08.060(G-I), Council must approve change orders exceeding 5 percent. <br />NOW, THEREFORE, BE IT RESOLVED, that the Colton City Council hereby and <br />authorizes the amendment of the emergency repair work contract to be performed by Diversified <br />Utility Services, Inc. in the amount not to exceed $102,060.06, including the added $10,886.06 <br />change order. <br />23152.06020\32617662.1 <br />
