I <br />RESOLUTION NO. R-64-02 <br />2 A RESOLUTION OF THE COLTON UTILITY AUTHORITY OF THE CITY OF <br />3 COLTON RATIFYING THE CITY MANAGER'S DECLARATION OF AN <br />EMERGENCY AND THE ACTIONS HE DEEMED NECESSARY TO REPAIR <br />4 WELL NOS. 16 AND 23. <br />5 WHEREAS, Section 22050 of the State Public Contract Code governs emergency <br />6 11 contracting procedures applicable to the City of Colton. <br />7 11 WHEREAS, Section 22050 of the Public Contract Code allows the Colton Utility <br />s <br />Authority to pass a resolution by a four-fifths vote of its membership declaring that (a) <br />9 11 <br />emergency conditions that exist that do not permit a delay resulting from a competitive <br />10 <br />solicitation for bids; and (b) the repairs are necessary to respond to the emergency. <br />11 <br />12 11 WHEREAS, the Colton Utility Authority finds, based upon the Staff Report and other <br />13 11 information in the record, that emergency conditions exist at Well #16 and Well #23, which <br />14 meet the requirements of Section 22050, and that the City Manager took appropriate action <br />15 11to respond to such emergency. <br />1s <br />NOW, THEREFORE, BE IT RESOLVED that the Colton Utility Authority resolves as <br />17 follows: <br />1. The City Council hereby ratifies the City Manager's actions to order materials and <br />1a labor, in an amount not to exceed $17,554.09, to repair the pump at Well #16 and <br />19 an amount not to exceed $22,500.00 for Well #23, pursuant to Section 22050 of <br />the Public Contract Code, to respond to the stated emergency. <br />20 <br />PASSED, APPROVED and ADOPTED this 0 day of June 2002. <br />21 <br />22 <br />23 cul AAUX 1,/ W • J, <br />DEIRDRE H.
