RESOLUTION NO. R-54-23 <br /> 1 <br /> 2 A RESOLUTION OF THE CITY COUNCIL OF COLTON, CALIFORNIA, <br /> ORDERING THE LEVY AND COLLECTION OF ASSESSMENTS FOR THE <br /> 3 COLTON LANDSCAPE AND LIGHTING MAINTENANCE ASSESSMENT <br /> DISTRICT NO. II FOR FISCAL YEAR 2023/2024 <br /> 4 <br /> 5 WHEREAS, the City of Colton ("City") is a municipal corporation duly organized and <br /> existing pursuant to the Constitution and laws of the State of California; and <br /> 6 <br /> WHEREAS, the City Council of the City of Colton, California, has, by previous Resolutions, <br /> 7 <br /> initiated proceedings for the Colton Landscape and Lighting Maintenance Assessment District <br /> 8 No. II ("District"), declared its intention to levy assessments for Fiscal Year 2023/2024, and <br /> approved the Engineer's Annual Levy Report (Engineer's Report) that describes the <br /> 9 assessments against parcels of land within for the Fiscal Year commencing July 1, 2023 and <br /> ending June 30, 2024, pursuant to the provisions of the Landscaping and Lighting Act of 1972, <br /> 10 Part 2 of Division 15 of the California Streets and Highways Code, (commencing with Section <br /> 22500) ("Act") to pay for the maintenance services of improvements and facilities related <br /> i 1 thereto; and, <br /> 12 WHEREAS, the Engineer's Report has been prepared and filed with the City Clerk, and the <br /> 13 City Clerk has presented to the City Council said Engineer's Report in connection with the <br /> proposed levy and collection assessments upon eligible parcels of land within the District and the <br /> 14 City Council did by previous Resolution approve such Engineer's Report, and; <br /> 15 WHEREAS, the City Council desires to levy and collect assessments against parcels of <br /> land within the District for the Fiscal Year commencing July 1, 2023 and ending June 30, 2024, <br /> 16 to pay for the maintenance and services of improvements and facilities related thereto. <br /> 17 NOW, THEREFORE BE IT RESOLVED, DETERMINED, AND ORDERED BY THE CITY <br /> 18 COUNCIL FOR THE DISTRICT, AS FOLLOWS: <br /> 19 Section 1 Following notice duly given, the City Council has held a full and fair public hearing <br /> regarding the District, the levy and collection of assessments, the Engineer's Report prepared in <br /> 20 connection therewith, and considered oral and written statements, protests and communications <br /> made or filed by interested persons regarding these matters. <br /> 21 <br /> Section 2 Based upon its review of the Engineer's Report(and amendments, as applicable), the <br /> 22 City Council hereby finds and determines that: <br /> 23 • The land parcels within the District will be benefited by the operation, maintenance and <br /> 24 servicing of the improvements located within the boundaries of the District; and, <br /> 25 • The District includes the parcels of land so benefited; and, <br /> 26 • The net amount to be assessed upon the parcels of land within the District for the Fiscal <br /> Year commencing July 1, 2023 and ending June 30, 2024 is apportioned by a formula and <br /> 27 method which fairly distributes the net amount among eligible parcels in proportion to the <br /> estimated special benefits to be received by each parcel from the improvements and <br /> 28 services. <br />
