1 RESOLUTION NO. 2445 <br /> 2 RESOLUTION OF THE CITY COUNCIL OF THE CITY <br /> OF COLTON DECLARING WEEDS GROWING UPON <br /> 3 THE STREETS OR SIDEWALKS OR UPON PRIVATE <br /> PROPERTY AND RUBBISH, REFUSE OR DIRT UPON <br /> 4 PARKWAYS SIDEWALKS OR PRIVATE PROPERTY <br /> WITHIN THE CITY OF COLTON TO BE A PUBLIC <br /> 5 NUISANCE AND PROVIDING FOR THE ABATEMENT <br /> THERE FOR IN ACCORDANCE WITH SECTIONS 39560, <br /> 6 39561 , 39561. 5, 39562, 39563, 39567.1 ALSO 39568- <br /> 39586 CHAPTER 13, ARTICLE 3, TITLE 4, DIVISION 3 <br /> 7 OF THE GOVERNMENT CODE OF THE STATE OF <br /> CALIFORNIA. <br /> 8 <br /> WHEREAS, the City Council of the City of Colton has been informed <br /> 9 <br /> that there are growing upon the streets and sidewalks and private property <br /> 10 <br /> within said City many weeds which have seeds of a wingy or downy nature or <br /> 11 <br /> have attained such growth as to become a fire menance or which are otherwise <br /> 12 <br /> noxious or dangerous and there is also existing on certain parkways, sidewalks <br /> 13 <br /> and property within the City certain rubbish, refuse and dirt including dry <br /> 14 <br /> grass, stubble, brush, litter or other flammable material which endangers the <br /> 151 <br /> public safety by creating a fire hazard, and <br /> 16 <br /> WHEREAS, the City Council is of the opinion that same should be <br /> 17 <br /> declared a public nuisance and should be abated in accordance with provisions <br /> 18 <br /> of the Weed Abatement Law (Chapter 13, Title 4, Division 3, Government Code <br /> 19 <br /> and amendments thereto) of the State of California, and <br /> 20 <br /> WHEREAS, the Street Superintendent has prepared a report properly <br /> 21 <br /> describing the property upon which the condition exists„ <br /> 22 <br /> NOW, THEREFORE, BE IT RESOLVED by the City Council of the City <br /> 23 <br /> of Colton as follows <br /> 24 <br /> 1, That the City Council does hereby find, determine and declare that <br /> 25 <br /> there are growing upon the streets and sidewalks and private property within <br /> 26 <br /> said city many weeds which have seeds of a downy nature or have attained such <br /> 27 <br /> growth as to become a fire menance or which are otherwise noxious or danger- <br /> 28 <br /> ous and that there is also existing on certain parkways, side walks, and prop- <br /> 29 <br /> erty within the City certain rubbish, refuse and dirt including dry grass, <br /> 30 <br /> stubble, brush, litter or otherwise flammable material which endangers the <br /> 31 <br /> public safety by creating a fire hazard, <br /> 32 <br />
