1 ORDINANCE NO. 0-05-24 <br /> 2 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br /> COLTON AMENDING VARIOUS SECTIONS OF TITLE 18 OF <br /> 3 THE COLTON MUNICIPAL CODE TO PERMIT AND REGULATE <br /> ELECTRIC VEHICLE CHARGING STATIONS AND HYDROGEN <br /> 4 VEHICLE CHARGING STATIONS PURSUANT TO CALIFORNIA <br /> GOVERNMENT CODE SECTION 65850.7 <br /> 5 <br /> WHEREAS, California Government Code section 65850.7, as recently amended by <br /> 6 Senate Bill 1291, requires cities and other local governments to regulate and permit electrical <br /> 7 vehicle charging stations and hydrogen fuel-cell vehicle fueling stations through a streamlined <br /> building permit process, subject to the terms and conditions stated therein; and <br /> 8 <br /> 9 WHEREAS, by adoption of this Ordinance, the City Council desires to update and <br /> modernize its zoning and development regulations to comply with Government Code section <br /> 10 65850.7 and thereby promote the orderly development of electric vehicle charging stations and <br /> 11 hydrogen fuel-cell vehicle fueling stations within the City, consistent with State law; and <br /> 12 WHEREAS, the Colton Planning Commission held a duly noticed public hearing to <br /> consider the Ordinance, and by a vote of 5 to 0, recommended its approval to the City Council; <br /> 13 and <br /> 14 WHEREAS, all prerequisites to the adoption of this ordinance have occurred. <br /> 15 NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF COLTON, <br /> 16 CALIFORNIA,DOES HEREBY ORDAIN AS FOLLOWS: <br /> 17 SECTION 1. Incorporation of Recitals. The City Council hereby finds that all of the <br /> 18 foregoing recitals presented herewith are true and correct and are hereby incorporated and adopted <br /> as findings of the City Council. <br /> 19 <br /> 20 SECTION 2. The City Council of the City of Colton hereby adopts this Ordinance based <br /> on the following findings: <br /> 21 <br /> 22 A. General Plan Consistency. Based on the entire record before the City Council and all <br /> written and oral evidence presented, including the staff report,the City Council hereby <br /> 23 finds and determines that the proposed Ordinance is consistent with the goals and <br /> 24 policies of the City of Colton General Plan and is reasonably related to the public <br /> welfare of the citizens of the City and surrounding regions. Specifically,the provisions <br /> 25 of this Ordinance promote the use of electric vehicles and hydrogen fuel-cell vehicles <br /> 26 by allowing electric vehicle charging stations and hydrogen vehicle fueling stations to <br /> be approved administratively in the City to be consistent with California Government <br /> 27 Code section 65850.7, as recently amended by Senate Bill 1291.
