1 ORDINANCE NO. 0-05-24 2 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF COLTON AMENDING VARIOUS SECTIONS OF TITLE 18 OF 3 THE COLTON MUNICIPAL CODE TO PERMIT AND REGULATE ELECTRIC VEHICLE CHARGING STATIONS AND HYDROGEN 4 VEHICLE CHARGING STATIONS PURSUANT TO CALIFORNIA GOVERNMENT CODE SECTION 65850.7 5 WHEREAS, California Government Code section 65850.7, as recently amended by 6 Senate Bill 1291, requires cities and other local governments to regulate and permit electrical 7 vehicle charging stations and hydrogen fuel-cell vehicle fueling stations through a streamlined building permit process, subject to the terms and conditions stated therein; and 8 9 WHEREAS, by adoption of this Ordinance, the City Council desires to update and modernize its zoning and development regulations to comply with Government Code section 10 65850.7 and thereby promote the orderly development of electric vehicle charging stations and 11 hydrogen fuel-cell vehicle fueling stations within the City, consistent with State law; and 12 WHEREAS, the Colton Planning Commission held a duly noticed public hearing to consider the Ordinance, and by a vote of 5 to 0, recommended its approval to the City Council; 13 and 14 WHEREAS, all prerequisites to the adoption of this ordinance have occurred. 15 NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF COLTON, 16 CALIFORNIA,DOES HEREBY ORDAIN AS FOLLOWS: 17 SECTION 1. Incorporation of Recitals. The City Council hereby finds that all of the 18 foregoing recitals presented herewith are true and correct and are hereby incorporated and adopted as findings of the City Council. 19 20 SECTION 2. The City Council of the City of Colton hereby adopts this Ordinance based on the following findings: 21 22 A. General Plan Consistency. Based on the entire record before the City Council and all written and oral evidence presented, including the staff report,the City Council hereby 23 finds and determines that the proposed Ordinance is consistent with the goals and 24 policies of the City of Colton General Plan and is reasonably related to the public welfare of the citizens of the City and surrounding regions. Specifically,the provisions 25 of this Ordinance promote the use of electric vehicles and hydrogen fuel-cell vehicles 26 by allowing electric vehicle charging stations and hydrogen vehicle fueling stations to be approved administratively in the City to be consistent with California Government 27 Code section 65850.7, as recently amended by Senate Bill 1291.
