ITEM #4 <br />CITY OF COLTON <br />AGENDA REPORT <br />TO: HONORABLE MAYOR AND CITY COUNCIL MEMBERS <br />FROM: AMER JAKHER, P.E.,, PW DIRECTOR / CITY ENGINEER <br />.S-UBJECT: APPROVE AN ORDINANCE -OF THECITY COUNCIL OF THE CITY <br />OF COLTON, AMENDING SECTIONS 18.52.010 AND 18.58.30, OF <br />TITLE 18, OF THE COLTON MUNICIPAL CODE AUTHORIZING <br />THE DIRECTOR OF PUBLIC WORKS TO DETERMINE AND FILE <br />ALL RELATED DOCUMENTS FOR THE CALIFORNIA <br />ENVIRONMENTAL QUALITY ACT (CEQA) STATUS OF PUBLIC <br />WORKS PROJECTS. <br />DATE: JULY 111 2006 <br />BACKGROUND: <br />Title 18 of the City of Colton Municipal Code addresses Zoning. Section 18.58.010 addresses the <br />administrative roles of City Council, Planning Commission, the Design Review Committee, and <br />Community Development Department regarding matters relating to zoning regulations, building <br />permits and business occupancy permits. Section 18.58.30 of Title 18 of the City's Municipal Code <br />delineates the procedure pertaining to Design Review Procedures. Additionally, Section C(5) of <br />18.58.30 addresses who, makes the determination regarding preparation of environmental <br />documents pursuant to the California Environmental Quality Act (CEQA). All roles and <br />procedures stated within Title 18 do not reference or give direction when processing CEQA <br />documents for internal Public Works Projects. <br />ANALYSIS/DISCUSSION: <br />As currently written, the Municipal Code does not specify who has the authority to review and <br />approve matters pertaining to environmental review pursuant to CEQA and the City's local CEQA <br />guidelines in regard to internal Public Works Projects. As a result, the Public Works Department <br />relies on the Community Development Department to process CEQA documentation for capital <br />infi-astructure projects. <br />All projects currently go to the Design Review Committee, City Council, Planning Commission or <br />Community Development Department and then go through the CEQA process. The Community <br />Development Department is generally not as familiar with the intricacies of capital infi-astructure <br />projects as are the Public Works Department's Director and staff. To decrease any resulting delays, <br />which can also financially impact a Public Work Projects, staff is respectfully recommending City <br />
